|a يعد القضاء الدولي آلية حيوية لتسوية المنازعات الاستثمارية التي تنشأ بين الدول والمستثمرين الأجانب. مع تزايد العولمة والتدفقات الاستثمارية عبر الحدود، تبرز الحاجة إلى نظام قانوني عادل وفعال لحل النزاعات الاستثمارية. يتيح القضاء الدولي عبر مؤسسات مثل محكمة التحكيم الدائمة ومحكمة العدل الدولية ومحكمة الاستثمار العربية، للمستثمرين والدول الوصول إلى تسويات قانونية متوازنة. سنقوم بدراسة فعالية هذه الأجهزة ودورها في تحقيق تسويات قانونية متوازنة، مما يضمن الثقة المتبادلة ويحفز الاستثمارات الأجنبية المباشرة. تتجلى أهمية هذا النظام في تعزيز التنمية الاقتصادية والاستقرار السياسي في الدول المضيفة، وبالتالي خلق بيئة استثمارية مستقرة وآمنة على الصعيد العالمي.
|b International adjudication serves as a vital mechanism for resolving investment disputes between states and foreign investors. The need for a fair and effective legal system to address investment disputes becomes evident with the increasing globalization and cross-border investment flows. International adjudication, through institutions such as the Permanent Court of Arbitration, the International Court of Justice, and the Arab Investment Court, allows investors and states to achieve balanced legal settlements. This study will examine the effectiveness of these bodies and their role in achieving balanced legal settlements, thereby ensuring mutual trust and stimulating foreign direct investment. The importance of this system is reflected in its contribution to economic development and political stability in host countries, consequently creating a stable and secure investment environment globally.
