|a إن تبني المشرع الجزائري لنظام الشهر العيني لشهر مختلف التصرفات الواقعة على العقارات الحقوق العينية العقارية، يعد قفزة إيجابية نحو نظام غاية في التنظيم والدقة، غير أن إعماله على أرض الواقع شهد صعوبات ومشكلات عملية، وهذا ما خلق منازعات عديدة ومتعددة أثقلت كاهل القضاء. وقد وضع كل من الأمر 75/74، وما صاحبه من مراسيم تنفيذية قواعد موضوعية وإجرائية لمنازعات السجل العيني من أجل حماية الحقوق العينية للأشخاص من كل اعتداء، إلا أن عدم وضوح هذه النصوص القانونية تارة وغيابها تارة أخرى، خلق عدة إشكالات كشف عنها الواقع العملي وتضاربت بشأنها الآراء ولم يستطع مرفق القضاء وضع اجتهادات قضائية من شأنها أن تسد الفراغ التشريعي.
|b The adoption by the Algerian legislator of the regime of real publicity to publish the various actions on land and real rights, is a positive step towards a very organized and precise system, but its implementation on the ground has encountered difficulties and practical problems, which has created many and multiple disputes that have burdened the judiciary.. Ordinance 75/74 and the accompanying implementing decrees established rules for disputes relating to real registers in order to protect the real rights of individuals against any attack, but the lack of clarity of these legal texts at certain times and their absence at other times, have created several problems revealed by practical reality, and conflicting opinions about them, and the judiciary has not been able to develop jurisprudence that could have filled the legislative vacuum.
