المستخلص: هدفت الدراسة إلى التعرف على بعض العقوبات السالبة للحرية قصيرة المدة السائدة في الأنظمة الجزائية، رغم المطالبات بتطبيق بدائل عنها تمكِّن المحكوم عليه من تنفيذ عقوبته خارج السجن أو داخل السجن بمدد أقل مع الاشتغال بما يعود بالنفع على المسجون، وذلك بهدف تحقيق هدف السياسة الجنائية الحديثة وهو إصلاح الجاني وتأهيله وإعادته فرداً صالحاً في المجتمع الذي يعيش فيه. العقوبات البديلة في دراستي أرجو أن تطبق في سبيل تحقيق الهدف المنشود، وقد عمل المنظم السعودي على تخفيف العقوبات على الجناة في السجون السعودية من المواطنين أو الأجانب عند حفظ القرآن كعقوبة بديلة وهي في الحقيقة كرامة، ويشترط أن يكون الجرم المرتكب من ضمن الجرائم البسيطة، وعليه قسمنا دراستنا هذه إلى مبحثين. وتوصلت إلى نتائج أن الحافظين للقرآن بعد خروجهم من السجن يصبحون أكثر نفعا، وأكثر ردعا للجريمة وناصحين للمجتمع الذي يعيشون فيه. وكانت التوصيات: أن السجين لابد من إحياء روح النفع للمجتمع فحفظه للقرآن يزيده معرفة بأحكام الشريعة، ويكون أكثر خوفا من الله، وجود دور لحفظ القرآن داخل السجون وتشجيع النزلاء بحفظ القرآن، بث روح التعاون بين إدارة السجون والنزلاء لزيادة الوعي بتعلم القرآن وحفظه.

In this study, the researcher sought to identify some of the short-term custodial punishments prevalent in penal systems, despite demands to apply alternatives to them that enable the convict to carry out his sentence outside prison or inside the prison for shorter periods while working on what benefits the prisoner, with the aim of achieving the goal of the policy. Modern criminal justice involves reforming and rehabilitating the offender and making him a good member of the society in which he lives. Alternative punishments are considered, which in my study I hope will be applied in order to achieve the desired goal of modern criminal policy. The Saudi regulator has worked to reduce punishments for perpetrators in Saudi prisons, whether citizens or foreigners, when memorizing the Qur’an as an alternative punishment, which is in fact a dignity, and it is required that the crime committed be Among the minor crimes, we divided this study into two sections. I have come to the conclusion that those who have memorized the Qur’an after their release from prison become more useful. They even become more deterrent to crime and are advisors to the society in which they live. The study concluded with recommendations, including: that the prisoner must revive the spirit of benefit to society, as memorizing the Qur’an increases his knowledge of the provisions of Sharia, and makes him more fearful of God, having roles for memorizing the Qur’an inside prisons and encouraging inmates to memorize the Qur’an, spreading the spirit of cooperation between the prison administration and inmates to increase awareness of learning and memorizing the Qur’an.
