بادئ ذي بدء ولما كان للحرية الشخصية من أهمية عالمية جعلتها تحتل السطور الأولى في كافة الدساتير والمواثيق الدولية، الأمر الذي بات من الضروري معه الوقوف على الضوابط الدستورية لحماية الحرية الشخصية في إطار الشرعية الدستورية في كل من النظام الدستوري المصري والفرنسي وهذا يتطلب التعرض إلى الأسس العامة لحماية الحرية الشخصية في إطار الشرعية الدستورية المتمثلة في وضع ضوابط لسيادة الدستور وسيادة القانون وترسيخ الديموقراطية والتأكيد على مبدأ الفصل بين السلطات وتلك الأسس هي التي تقوم عليها الدولة القانونية، ولا يمكن أن تنعت الدولة بالقانونية ما لم تكن لقواعد الدستور السمو والسيادة على جميع القواعد القانونية في الدولة في إطار عام من الرقابة الدستورية كضمانة لحماية الحرية الشخصية على النحو المطابق للأوضاع المقررة قانونا بما يتوافق مع الأنظمة الدستورية في مصر وفرنسا. لذا ناقش هذا البحث ضوابط الحماية الدستورية للحرية الشخصية والأسس العامة لتلك الحماية في النظامين الدستوري المصري والفرنسي، ومدى اختيار الرقابة الدستورية الملائمة كضمانة لحماية الحرية الشخصية في مواجهة سلطات الدولة في ظل دولة القانون التي يسمو فيها الدستور على ما سواه من القواعد القانونية في الدولة.
First of all, since personal freedom has global importance, it occupies the first lines in all constitutions and international charters, which has become necessary to examine the constitutional controls to protect personal freedom within the framework of constitutional legitimacy in both the Egyptian and French constitutional systems, This requires exposure to the general foundations for protecting personal freedom within the framework of constitutional legitimacy represented in establishing controls for the supremacy of the constitution and the rule of law, consolidating democracy, and emphasizing the principle of separation of powers. These foundations are what the legal state is based on, and the state cannot be described as legal unless the rules of the constitution have supremacy and sovereignty over all legal rules in the state within a general framework of constitutional oversight as a guarantee to protect personal freedom in a manner consistent with the legally established conditions in accordance with the constitutional systems in Egypt and France. Therefore, this research discussed the controls of constitutional protection of personal freedom and the general foundations of that protection in the Egyptian and French constitutional systems, and the extent of choosing the appropriate constitutional oversight as a guarantee to protect personal freedom in the face of the state authorities in the shadow of the state of law in which the constitution is superior to all other legal rules in the state.
