يتناول البحث سلطة الإدارة حول موضوع منح الترخيص للاستثمار الأجنبي من إشكاليات تستدعي الوقوف عندها وإزالة اللبس عنها ببيان التحليل القانوني لسلطة جهة الإدارة في منح التراخيص للاستثمار الأجنبي وذلك من خلال استقراء أحكام الأنظمة واللوائح المنظمة والمتصلة بشكل مباشر بمنظومة الاستثمار في المملكة وما تتقاطع معه من أنظمة أخرى مع تدعيم ذلك بطائفة من الأحكام القضائية الصادرة من ديوان المظالم بشأن تراخيص الاستثمار الأجنبي واعتمد البحث على المنهج التحليلي والاستقرائي، كما تم التوصل في هذا البحث إلى عدد من النتائج والتوصيات منها أن الترخيص الإداري للاستثمار الأجنبي صورة من صور القرارات الإدارية وذلك وفقا لما استقر عليه قضاء ديوان المظالم في المملكة. كما انتهينا إلى توصية بتطوير التشريعات بإجراء تعديلات على نظام الاستثمار الأجنبي ولائحته التنفيذية، بما يواكب تحويل جهاز الهيئة العامة للاستثمار إلى- وزارة للاستثمار- وبما يتفق مع مستهدفات رؤية المملكة ٢٠٣٠م، إذ أن آخر تعديل لعدد من مواد نظام الاستثمار الأجنبي كان بتاريخ 13/10/١٤٤٢هـ، وآخر تعديل للائحته التنفيذية كان بتاريخ 12/5/١٤٣٥هـ.
The research deals with the authority of the administration on the subject of granting a license for foreign investment from problems that require standing at them and removing ambiguity from them by stating the legal analysis of the authority of the administration in granting licenses for foreign investment by extrapolating the provisions of the systems and regulations organizing and directly related to the investment system in the Kingdom and what intersects with it from other systems, supporting that with a group of judicial rulings issued by the Board of Grievances regarding foreign investment licenses. The research relied on the analytical and inductive approach, and a number of results and recommendations were reached in this research, including that the administrative license for foreign investment is a form of administrative decisions, according to what has been established by the judiciary of the Board of Grievances in the Kingdom. We also concluded with a recommendation to develop legislation by making amendments to the Foreign Investment System and its executive regulations, in line with the transformation of the General Investment Authority into a Ministry of Investment, and in line with the objectives of the Kingdom’s Vision 2030, as the last amendment to a number of articles of the Foreign Investment System was on 10/13/1442 AH, and the last amendment to its executive regulations was on 5/12/1435 AH.
