|a تعد جريمة الإبادة الجماعية أحد أخطر الجرائم الدولية فتكاً بالإنسان، ونظراً للخطورة العظيمة لهذه الجريمة فقد أُبرمت عام 1948 اتفاقية دولية خاصة بمنعها والمعاقبة عليها، كما شكلت محوراً هاماً أثناء وضع النظام الأساسي للمحكمة الجنائية الدولية سنة 1998، وأدرجت هذه الجريمة كذلك ضمن الجرائم المعاقب عليها في القوانين الأساسية للمحاكم الدولية الخاصة وحتى المحاكم المدولة، حيث سنحاول من خلال هذه الورقة البحثية تسليط الضوء على أعمال الإبادة التي يقوم بها جنود الكيان الصهيوني ضد المدنيين في قطاع غزة بفلسطين المحتلة أمام العجز الواضح للمحكمة الجنائية الدولية عن التحرك للتصدي لها، وما هي سبل التصدي لتلك الانتهاكات في ظل القانون الدولي الجنائي والإنساني.
|b The crime of genocide is one of the most serious international crimes deadly to humans. Due to the great gravity of this crime, an international convention was concluded in 1948 on its prevention and punishment. It also formed an important focus during the development of the International Criminal Court 1998 statute.
