أدى التطور الهائل الذي شهده العالم في القرن الماضي في كافة مجالات الحياة وخاصة الصناعية إلى تدمير البيئة وتلوث الهواء بسبب الأبخرة المتصاعدة من المنشآت الصناعية واحتراق الوقود كالنفط والفحم والخشب، مما أدى إلى التأثير على كل كافة مناحي الحياة على الأرض وقد أدت هذه التغيرات إلى حدوث الكثير من المخاطر الكوارث البيئية والتأثير على صحة الإنسان وفقدان التنوع الحيوي... وقد أكدت اللجنة الحكومية الدولية المعنية بتغير المناخ (IPCC) أن أدلة قوية تشير إلى أن معظم السخونة الملاحظة على مدار آخر ٥٠ عاما يمكن نسبتها إلى الأنشطة البشرية. ليدخل خطر التغير المناخي إلى ساحة القانون الدولي والعلاقات الدولية بقوة خلال العقود الثلاثة الماضية، وأصبح محط اهتمام استراتيجيات دولية وضعت لمواجهته باعتباره قضية كونية تهدد دول العالم مجتمعة، فمنذ أوائل التسعينيات من القرن الماضي، تحاول الأمم المتحدة، عقد مؤتمرات قمة في أماكن متعددة عبر العالم لإيجاد سياسات عالمية مشتركة لمواجهة التغير المناخي. وقد أسفرت الجهود الدولية عن اتفاقية الأمم المتحدة الإطارية بشأن تغير المناخ لعام ۱۹۹۲ والمعروفة باسم CCNUCC التي تعد أساس الالتزامات والتعهدات الدولية في مجال تخفيض الانبعاثات الغازية الملوثة ومكافحة التغيرات المناخية والحد من آثارها.
The tremendous development witnessed by the world in the last century in all areas of life, especially industrial, has led to the destruction of the environment and air pollution due to fumes rising from industrial facilities and the burning of fuel (such as oil, coal and wood), which has affected all aspects of life on Earth. These changes have led to many risks, environmental disasters, impacts on human health and loss of biodiversity... The Intergovernmental Panel on Climate Change (IPCC) has confirmed that "strong evidence indicates that most of the warming observed over the past 50 years can be attributed to human activities. The threat of climate change has entered the arena of international law and international relations forcefully during the past three decades, and has become the focus of international strategies developed to confront it as a global issue that threatens the countries of the world together. Since the early nineties of the last century, the United Nations has been trying to hold summit conferences in various places around the world to find common global policies to confront climate change. International efforts have resulted in a set of international agreements that we will discuss in this research.
