|a لقد أصل فقهاء الشريعة الإسلامية لفكرة التبعية من خلال وضعهم لقاعدة التابع تابع، ويقصد بالتبعية وجود متبوع يرتبط به تابع ويمتد إليه حكمه وجوداً وعدماً، لذا فان للتبعية عناصر لا بد من توفرها لتحقق العلاقة التبعية وهي تابع ومتبوع مع رابطة تربط الأول بالثاني، ونجد لهذه القاعدة تطبيقات في العقود المختلفة ومنها العقود المسماة، واخترنا نموذجاً منها عقدي البيع والإيجار كأمثلة على عقود التمليكات والمنافع، لكون بحثنا لا يتسع لاحتواء جميع تلك العقود المتعددة.
