|a تتناول هذه الدراسة أهم الآليات الكفيلة بحماية الحريات والحقوق الأساسية والمتمثلة في القضاء الإداري، كتجسيد للضمانات القضائية المنصوص عليها في دستور الإمارات العربية المتحدة؛ من خلال مبدأ "الحق في التقاضي والطعن في القرارات الإدارية"، فكل قرار اتخذ في المجال الإداري، سواء كان تنظيميا أو فرديا يمكن الطعن فيه أمام الهيئة القضائية المختصة. وذلك باعتبار حق التقاضي مضمون لكل شخص الدفاع عن حقوقه وعن مصالحه التي يحميها القانون. وعلى هذا الأساس، يتجلى لنا مدى أهمية دور القضاء الإداري في حماية حقوق الإنسان في دولة الإمارات عبر اختصاصاتها الأساسية والمتمثلة في رقابة مشروعية القرارات الإدارية ورقابة أعمال وأنشطة الإدارة من خلال آلية دعوى الإلغاء والقضاء الشامل.
|b This study addresses the most important mechanisms for protecting fundamental freedoms and rights in the administrative judiciary, as a reflection of the judicial guarantees provided for in the Constitution of the United Arab Emirates; Through the principle of "the right to litigate and appeal administrative decisions", any decision taken in the administrative sphere, whether organizational or individual, can be appealed to the competent judiciary. The right to litigate is guaranteed to everyone to defend their rights and interests protected by law. On this basis, the important role of the administrative judiciary in the protection of human rights in the United Arab Emirates is reflected in its basic competence to monitor the legitimacy of administrative decisions and to oversee the work and activities of the administration through the mechanism of annulment and comprehensive judicial proceedings.
