|a هدفت هذه الدراسة إلى بيان أسس ومقاصد الحق في الموارد المائية من خلال ما تطرقت له كثير من الآيات والأحاديث الشريفة التي تدعو إلى الحفاظ على المحيط الذي يعيش فيه الإنسان، حفاظاً على حياته وحياة الكائنات الحية الأخرى من خلال السنة المائية؛ لأن الحفاظ على الماء يعتبر من صميم مقصد الشريعة الإسلامية التي جاءت لإسعاد البشرية وتحقيق مصالح العباد. والبحث يحاول التأصيل لذلك؛ باعتبار الماء أحد أهم موجودات البيئة، وكذلك إبراز جملة من الآداب والأحكام والتشريعات التي تحفظ لهذا العنصر المهم البقاء والاستمرار، فالشريعة الإسلامية بجميع أحكامها وتصرفاتها ترمي إلى مقاصد عامة تسعى من خلالها إلى تحقيق مصالح الإنسان بإسعاد الفرد والجماعة وهو الملحوظ من خلال محاوره لبيان أهمية الماء في الحياة بالنسبة للإنسان في الحاضر والمستقبل.
|b This study aims to clarify the basis and rationale behind the water distribution rights, through several Quranic verses and hadiths of the prophet, that primarily call for the conservation of the human environment, through these Islamic practices to preserve their life and that of other creatures, water conservation is a staple of the Islamic body of laws that ensures the welfare of humanity. This research attempts to demonstrate its roots in the literature, given that water is one of the most crucial necessities to the environment, it highlights the collective works and rules and legislations that regulate water sustainability. The body of Islamic laws in all of its rulings and teachings aims to the collective good for humanity which is apparent from its persistence on water conservation for today and for our humanity's future.
