|a شهدت المملكة العربية السعودية في السنوات الأخيرة تحديثاً شاملاً في التشريعات القانونية لمواكبة التطورات في شتى المجالات، حيث تلعب هذه التشريعات دوراً حيوياً في تحقيق التوازن بين التنمية الاقتصادية وحماية حقوق الأفراد والبيئة، ويعد نظام المسؤولية المدنية عن الأضرار النووية أحد أهم هذه التشريعات، حيث يسعى لتنظيم المسؤولية المترتبة عن الأضرار النووية وضمان حصول المتضررين على التعويض العادل، وعليه تتناول هذه الورقة البحثية ماهية المسؤولية المدنية عن الأضرار النووية وأحكامها وذلك من خلال توضيح الأساس القانوني لها وبيان حدود مسؤولية مشغل المنشأة النووية والآثار المترتبة على انعقاد مسؤوليته ابتداء من دعوى المسؤولية إلى تقدير التعويض المناسب الذي يلائم حجم الضرر. يقصد بالكلمات والعبارات الآتية -أينما وردت في هذا البحث- المعاني الموضحة أمام كل منها، ما لم يقتض السياق غير ذلك: النظام السعودي: نظام المسؤولية المدنية عن الأضرار النووية الصادر عام 1439هـ. المشغل: مشغل المنشأة النووية. التعويض: الجبر النقدي أو العيني.
|b In recent years, the Kingdom of Saudi Arabia has witnessed a comprehensive update in legal legislation to keep pace with developments in various fields, as these legislations play a vital role in achieving a balance between economic development and protecting the rights of individuals and the environment. The Civil Liability for Nuclear Damage System is one of the most important of these legislations, as it seeks to address the risks associated with nuclear energy and ensure that those affected receive fair compensation. Accordingly, this research paper addresses the nature of civil liability for nuclear damages and its provisions by clarifying its legal basis and stating the limits of the liability of the operator of the nuclear facility and the effects resulting from the establishment of his liability, starting from the liability claim to estimating the appropriate compensation that is commensurate with the extent of the damage. The following words and phrases- wherever they appear in this research- have the meanings shown in front of each of them, unless the context requires otherwise: Saudi Law: Civil Liability for Nuclear Damage System issued in 1439 AH.
