المستخلص: يهدف البحث إلى بيان أهمية نشر ثقافة المقاصد كضرورة شرعية؛ لضبط الفتوى ومحاربة الشاذ منها، ولكونها تعالج قضية مؤثرة في حياة المجتمعات. التعرف على العلاقة بين مقاصد الشريعة والفتاوى، خاصة في عصر تنازعت فيه الفتوى بين الغلو والتفريط؛ لإعمال المقاصد بيان خطورة الغفلة عن تطبيق المقاصد الشرعية على الفتوى، مما يوقع في الزيغ والضلال بيان العقوبات الشرعية والنظامية لمروجي الفتاوى الشاذة، والمصادمة لمقاصد الشريعة، وتلك ضرورة للحد من انتشارها، فإن الله يزع بالسلطان ما لا يزع بالقرآن ضرب الأمثلة وعرض نماذج للفتاوى الشاذة، الصادرة من غير مراعاة مقاصد الشرع وحكمه، وآثارها السلبية على أمن الأمة التنبيه على ضرورة تعاون وتضافر جهود المؤسسات الدينية والتعليمية وغيرها في نشر علم المقاصد، وهي موجودة أصلا، إلا أنه استجد ما يستدعي إعادة الاجتهاد فيها، وتلك وقاية قبل الحماية. وقد سلكت في هذا البحث المنهج الاستقرائي والوصفي والاستنتاجي، والذي أبين فيه أهمية العناية بعلم مقاصد الشريعة، وتفعيل الجانب العملي التطبيقي؛ لمحاربة الفتاوى الشاذة، ومن ثم الوصول إلى الرؤى المستقبلية والتدابير الشرعية لتفعيل ذلك أهم المقترحات والتوصيات ضرورة إفراد القواعد المقاصدية بالعناية والتأليف والدراسة، ويمكن جعله قسما ثالثا مستقلا، بعد القواعد الفقهية، والقواعد الأصولية، وهذا فيه مسايرة وموافقة للاجتهاد المعاصر. إحياء فكرة التأهيل المقاصدي، وسن نظام الإجازات الشرعية والعلمية الدراسي المقاصد، تشمل الدعاة والمفتين وأعضاء هيئة التدريس، كل وفق تخصصه إنشاء ماجستير المقاصد الشرعية تأصيلا وتطبيقا، ويشتمل على مرحلتين الأولى: تأصيل الفكر المقاصدي من واقع كتب التراث الإسلامي، والثاني: التطبيق لمقاصد الشريعة في فقه النوال والمستجدات، ويهدف لتطوير العمل التشريعي للدعوة والإفتاء والتعليم التأكيد على أن الفتوى الجماعية القائمة على اعتبار المقاصد تعاون علمي مثمر وآمن من الوقوع في شذوذ الفتوى. إنشاء لجان متخصصة لضبط إعمال المقاصد في الفتوى، لمواجهة تعطيل النصوص الشرعية أو التهاون بها، بذريعة مراعاة المقاصد.

The research aims to show the importance of spreading the culture of purposes as a legitimate necessity, to control the fatwa and fight the gay ones, and because it addresses an issue that affects the life of societies. To know the relationship between the purposes of sharia and fatwas, especially in an era when the fatwa is disputed between extremism and waste, for the realization of purposes Statement of the seriousness of the omission of the application of legitimate purposes to the fatwa, which causes a misdirection The statement of the legal and systematic punishments for the promoters of the abnormal fatwas, which are contrary to the purposes of the Shariah, and that is a necessity to limit their spread, Because Allah claims to the Sultan what is not exalted by the Qur'an. Examples and examples of abnormal fatwas, issued without regard to the purposes of Islam and its ruling, and their negative effects on the security of the nation Warning of the need for cooperation and concerted efforts of religious and educational institutions and others in spreading the science of purposes, which exist in the first place, but it is new to the need to re-establish jurisprudence in them, and that is protection before protection. In this research, I have taken the extrapolating, descriptive and inference approach, in which I have shown the importance of taking care of the science of the purposes of sharia, and activating the practical and practical aspect, to combat abnormal fatwas, and then to reach future visions and legitimate measures to activate this. The most important proposals and recommendations The necessity of singling out the rules of purpose by care, authorship and study, and can be made a third independent section, after the rules of jurisprudence and the rules of fundamentalism, and this is in keeping with and agreeing with contemporary jurisprudence . Reviving the idea of purposeal rehabilitation and enacting the system of legal and scientific leave for the students of purposes, including preachers, muftis and faculty, each according to his specialty. The establishment of the Master of Islamic Purposes in rooting and applying, and includes two stages, the first: the rooting of the makassi thought from the reality of islamic heritage books, and the second: the application of the purposes of sharia in the jurisprudence of nawal and new developments, and aims to develop the legislative work of advocacy, fatwas and education. Affirming that the collective fatwa based on the consideration of purposes is a fruitful scientific cooperation and is safe from falling into the anomaly of the fatwa. Establishing specialized committees to control the implementation of the purposes of the fatwa, in order to face the disruption or negligence of the Islamic texts, under the pretext of taking into account the purposes and raising hardship and embarrassment.
