المستخلص: يهدف البحث إلى بيان أهمية تطبيق الميراث في الشريعة الإسلامية، وبيان عناية الإسلام بميراث المرأة مقارنة بالعصور السابقة، وإظهار حكم الشرع في إجبار المرأة على التنازل عن حقها في التركة إذا كانت عقارا، وإيضاح الأثر المترتب على هذا الإجبار، ونظرا لأهمية هذا الموضوع وما بدا لي من قيمة علمية له، لما تتعرض له معظم النساء من هضم لحقوقهن في الميراث بسبب جهل المجتمعات، وإيثار الذكور على الإناث، سلكت في كتابة هذا البحث المنهج الاستقرائي، والوصفي، والتحليلي، والاستنباطي، وانتهت الدراسة بخاتمة ضمنتها أهم النتائج التي توصلت إليها خلال البحث منها حرمة إجبار المرأة على التنازل عن حقها في التركة إذا كانت عقارا بأي وسيلة كانت، ويعتبر كل ما ترتب على هذا الإجبار من التصرفات أو العقود باطلا لا أساس له، وأهم التوصيات منها أن علم الميراث لا يكفي لإحياء العمل به مجرد الكتابة والبحث، بل يجب دعوة أهل العلم والدعاة من المسلمين إلى عرض موضوع الميراث عبر وسائل الإعلام المختلفة للتبصير بخطورة مخالفة أمر الله، وفهرس بالمصادر والمراجع التي استعنت بها، وفهرس بجميع الموضوعات التي تناولها البحث.

The research study deals with women and real estate inheritance in Upper Egypt; comparative jurisprudence study. It aims at demonstrating the importance of applying the inheritance rules in the Islamic Sharia revealing the care of Islam for the inheritance of woman compared to previous eras. It also indicates the sharia ruling on forcing a woman to give up her right to the inheritance if it is real estate and the effect of this obligation. Due to the importance of this topic and what is revealed to me from its scientific value which results from women's being subjected to infringement of their rights in inheritance because of ignorance of societies and male preference over females, I wrote this research utilizing the inductive, descriptive, analytical and deductive method. The study was ended by a conclusion that included the most important results of the research. Of these results is the prohibition of forcing woman to give up her right in inheritance if it is a real estate by any maens. Besides, the consequances that have taken place as a result of this obligation such as acts or contracacts are all considered untrue and baseless. The most important recommendations is that it is not sufficient to survive the science of inheritance through mere writing and research. Rather, it is obligatory to invite the people of knowledge and preachers to show the inheritance topic across different media to be aware of the seriousness of violating God' command . Also included is the a reference list for the resources I utilized and an index of all topics that are covered by the research.
