المستخلص: يتناول هذا البحث جمعا ودراسة للمسائل الأصولية المستدل لها بحديث: "لا تبع ما ليس عندك"، ويهدف إلى بيان دور السنة النبوية في استنباط وبناء القواعد الأصولية، وأنها من أهم الأدلة التي يحتج بها الأصوليون في كثير من المسائل؛ فتأتي مستقلة بالاستدلال فيكون الاعتماد الكامل عليها أو ينضم إليها دليل آخر فتكون حينئذ جزءا من الاستدلال، ولذلك كان لزاما على الباحثين العناية بها وبيان مدى أهميتها واتصالها الوثيق بعلم أصول الفقه، ورصد المسائل الأصولية التي استدل الأصوليون لها بالسنة، كما يسهم هذا البحث في الرد على من يدعي أن أدلة أصول الفقه أغلبها عقلية ومنطقية. ومن خلال تتبع الاستدلال بالسنة النبوية على المسائل الأصولية وجدت تكرار الاستدلال ببعض النصوص النبوية على مسائل متفرقة في الكتب الأصولية؛ فرغبت في الوقوف على أحد هذه النصوص وسبر المسائل الأصولية التي يمكن أن تستنبط منه ويستدل به عليها، فوقع اختياري على الحديث الذي رواه حكيم بن حزام رضي الله عنه أن النبي صلى الله عليه وسلم قال له: "لا تبع ما ليس عندك، فهذا الحديث مع وجازة لفظه إلا أنه يستدل به على عدد من المسائل المبثوثة في الأبواب الأصولية كالقياس، والاستحسان، والنهي والعموم، والبيان، والاشتراك، والمفهوم، ولما كانت هذه المسائل متفرقة في الكتب الأصولية أردت أن أجمع شتاتها في بحث مستقل وسميته: "المسائل الأصولية المستدل لها بحديث: "لا تبع ما ليس عندك جمعا ودراسة"، واقتضت طبيعة البحث أن أتبع المنهج الاستقرائي التحليلي، وقد انتظمت المادة العلمية في مقدمة، وتمهيد، ومبحثين؛ تضمنا عددا من المسائل الأصولية المستدل لها بهذا الحديث، ثم خاتمة بأهم النتائج والتوصيات، وفهارس، وقد انتهى البحث إلى بيان تفاوت الاستدلالات الأصولية بهذا الحديث، وأن أغلبها كان متعلقا بدلالات الألفاظ، وبعضها يتعلق بالأدلة، ويوصي البحث بمزيد العناية بالنصوص الشرعية استنباطا واستدلالا بها على القواعد الأصولية لما في ذلك من إثراء وتنمية للملكة الأصولية.

This research paper deals with the collection and study of the fundamental (usulian) issues that are inferred by the Hadith: "Do not sell what you do not have", and aims to show the role of the prophetic Sunnah in devising and building the fundamentalist rules, and that it is one of the most important evidences that the fundamentalists use in many issues. It comes as independently evidenced, so the complete reliance be on it or another evidence joins it, so it becomes part of the evidence then. Therefore, it was necessary for the researchers to take care of it,to show its importance and its close connection with the science of the Usul al-fiqh, and to monitor the fundamental(usulian) issues that the fundamentalists inferred by the Sunnah. This research paper also contributes to responding to those who claim that the evidences of the principles of jurisprudence(Usul al-fiqh)are mostly rational and logical. Through tracking the inference of the prophetic Sunnah on the fundamental (usulian) issues, I found a repeated inferences from some prophetic texts on various issues in the fundamentalist books; I wanted to study one of these texts and explore the fundamental issues that can be derived from and inferred by it. So I chose the Hadith narrated by Hakim bin Hizam- may Allah be pleased with him- that the Prophet- peace be upon him- said to him: "Do not sell what you do not have", this Hadith despite its concise wording but it is used as evidence on several fundamental (usulian) issues as: analogy, approbation, prohibition, generality, statement, participation, and conception. Since these issues are scattered in the fundamentalist books, I wanted to collect their fragments in an independent research paper entitling it: "The Fundamental Issues that are inferred by the Hadith: 'Do not sell what you do not have' Collection and Study.''' The nature of the research required that I should follow the inductive analytical approach. The scientific material was organized in an introduction; a preface; and two sections, which included a number of fundamental issues that are inferred by this hadith; then a conclusion with the most important results and recommendations; and indexes. The research paper concluding by showing the variations of the fundamental inferences by this Hadith, and that most of them were related to word meanings, and some of them were related to evidences. The research paper recommends more care for legal texts derivation and inference by them on the fundamental rules for what is in them of enriching and developing of the fundamental skill.
