المستخلص: تكتسي دراسة حقوق الطفل أهمية بالغة عند الباحثين المختصين في مجالات كثيرة كتخصص علم الاجتماع والقانون، والفقه الإسلامي؛ حيث اهتم هذا التخصص الأخير- أكثر من غيره- بهذه الحقوق من حيث الكثرة، ومن حيث السبق الزمني، والشاهد على ذلك الكتب الفقهية التي ورثناها عنهم، والتي شرعت لذلك انطلاقا واستنتاجا من الآيات القرآنية والأحاديث النبوية الواردة في هذا الموضوع؛ لكن المشكلة أن هذا العمل جاء موزعا على أبواب فقهية كثيرة حيث يصعب تتبعه، ويعسر فهمه والانتباه إليه على غير المتخصصين، فحاولت في هذه الدراسة جمع هذه الحقوق تحت عنوان واحد وربطها بأدلتها، وتنظيمها تنظيما منهجيا وفق عناوين تشكل قاسما مشتركا لكل مجموعة منها، وذلك لتقريبها للأفهام بأبسط طرح ممكن، وكان ذلك وفق المنهج الاستقرائي لتتبع سائر النصوص المتعلقة بموضوع الدراسة من الآيات والأحاديث وأقوال الفقهاء، وخلصت الدراسة إلى نتائج كان من أبرزها، أن الإسلام ضمن للطفل حقوقا قبل وجوده، وحقوقا وهو في بطن أمه، وحقوقا بعد وضعه، وحقوقا عند بداية تمييزه.

The study of children's rights holds great importance among researchers specialized in many fields such as sociology, law, and Islamic jurisprudence, as this latter specialization has been more concerned than others with these rights in terms of multiplicity and multiplicity, and in terms of time precedent. But the problem is that the work of this jurists came distributed over many jurisprudential chapters, where it is difficult to track it, and it is difficult to understand and pay attention to it to non- specialists, so this study aimed to try to collect all these rights under one title and link them to their evidence, and organize them systematically according to titles that constitute a common denominator for each group of them in order to bring them closer to the understandings in the simplest possible proposition. This was in accordance with the inductive approach to track all that is included in the subject of the study of verses, hadiths and sayings of jurists, and the deductive approach to analyze these verses, hadiths and other texts related to the subject, and this study reached the results of the most prominent of which was that Islam guaranteed the child rights before his existence, and rights while he is in the womb of his mother and rights after birth, and rights at the beginning of discrimination.
