يهدف هذا البحث إلى تسليط الضوء على القيمة الحضارية للأرشيف العثماني في أحد أبعادها الأدائية العملية، وهي القيمة القانونية الحمائية للأوقاف الإسلامية في العالم الإسلامي، وفيما كان ينتمي للعالم الإسلامي من أماكن وأقاليم خرجت عن حكم المسلمين وولايتهم. لقد خلص هذا البحث إلى أن المنفعة القانونية للأرشيف العثماني بعامة- والأرشيف الوقفي بخاصة- هي منفعة حقيقية يمكن توظيفها عمليا في حماية الأوقاف، وفي استردادها، وفي تفعيل جميع أساليب وأشكال صيانتها والدفاع عنها، بل وتحصينها ضد المخاطر المستقبلية التي تهدد أصولها، كما يمكن أن تكون التجربة الحمائية ذاتها مصدرا إرشاديا للتعامل مع التشريعات الوقفية في العالم بأسره، إصدارا وإشرافا وتكيفا. كما اتضح للباحث أن الأوقاف المقدسية خاصة، نظرا لوضعها الخاص على الصعد كافة وفي جميع المجالات، يجب أن تحظى باهتمام خاص ودراسات تاريخية وقانونية وسياسية معمقة لتقعيد أسس الانتفاع بالأرشيف العثماني؛ دفاعا عنها وحفاظا عليها في المعركة المفتوحة ومتعددة الميادين مع الاحتلال الصهيوني ومشاريعه التهويدية.
This research aims to highlight the cultural value of the Ottoman archives in one of their practical performance dimensions, the protectionist legal value of Islamic endowments in the Islamic world, as well as in places and territories outside Muslim rule and jurisdiction. This research concluded that the legal benefit of the Ottoman archives in general and the Waqf archives in particular is a real one that can practically be employed in the protection of endowments. and in their recovery, and in the operationalization and defense of all methods and forms of their maintenance and that the same protectionist experience could serve as an indicative source for dealing with the world's endowment legislation, promulgation, supervision and adaptation. The researcher also found that Al-Quds endowments, given their special status at all levels and in all spheres, must receive special attention and in-depth historical, legal and political studies to restore the foundations of utilization of the Ottoman archives; Defending and preserving it in open and multi-field battle with Zionist occupation and Judaism projects.
