|a فهذا بحث أصولي فقهي مقارن تناولت فيه بالبحث والدراسة موضوع مفيــــد نافع لطالب العلم ألا وهو أثر قاعدة (حمل المطلق على المقيد) في كتاب (إكمال المعلم بفوائد مسلم) للعلامة الفقيه المحدث الأصولي المالكي القاضي عياض بن موسى اليحصبي وهي قاعدة عظيمة وكبيرة من القواعد الأصولية اللغوية يندرج تحتها كثير من الفروع والمسائل والتطبيقات لذا أفرتها بالبحث والدراسة وجاء البحث بعد جمع مادته العلمية في مقدمة وثلاثة مطالب وفهرس للمصادر والمراجع. أما المقدمة ففيها أهمية البحث والموضوع. والمطلب الأول: في تعريف المطلق والمقيد لغة واصطلاحاً. والمطلب الثاني تناولت البحث الأصولي النظري وهو آراء الأصوليين في قاعدة حمل المطلق على المقيد وبينت فيه صور وحالات هذه القاعدة عند الأصوليين وحكم كل صورة وحالة. والمطلب الثالث تناولت الجانب التطبيقي وهو أثر قاعدة حمل المطلق على المقيد عند القاضي في الإكمال.
|b This is a comparative jurisprudential fundamental research in which I researched and studied a useful and useful topic for the seeker of knowledge, which is the effect of the rule (the absolute burden on the restricted) in the book (Implementing the Teacher with the Benefits of a Muslim) by the scholar, jurist, hadith scholar, fundamentalist Maliki, Judge Ayyad bin Musa Al-Yahsbi, which is a great and great rule of linguistic fundamentalism. Many branches, issues, and applications fall under it, so I covered it with research and study. The research came after collecting its scientific material in an introduction, three chapters, and an index of sources and references. As for the introduction, it contains the importance of the research and the topic. The first requirement: to define the absolute and the restricted linguistically and terminologically. The second topic dealt with the theoretical fundamentalist research, which is the opinions of the fundamentalists regarding the rule of applying the absolute to the restricted, and I explained in it the forms and cases of this rule according to the fundamentalists and the ruling on each form and situation. The third requirement dealt with the practical aspect, which is the effect of the rule of burdening the absolute on the restricted according to the judge regarding completion
