المستخلص: يتناول هذا البحث إحداث مذهب فقهي جديد على المذاهب الأربعة: أسباب تعذره، وأبرز محاولاته، واستخدمت الدراسة المنهج الاستقرائي في جمع المادة العلمية، والمنهج التحليلي في تحليلها، وقد توصلت الدراسة إلى أن معيار إحداث ذهب فقهي جديد يتمثل في الإتيان بمنهج اجتهادي مستقل عن المذاهب الأربعة منتج لفروع فقهية، وتوصلت أيضاً إلى تعذر إحداث مذهب فقهي لثلاثة أسباب: السبب الأول: تعذر إمكانية الإتيان بأصول جديدة في الشكل والمضمون، والسبب الثاني: وجود حدود لمساحة الاجتهاد الفقهي، وعدم إمكانية مخالفة الإجماع، والسبب الثالث: كفاية المذاهب الأربعة في القيام بالمهام الاجتهادية تأصيلاً وتطبيقاً، وعدم الحاجة لغيرها؛ لما حصل فيها من استقرار القواعد الأصولية ومناهج الاجتهاد، ولأجل وجود عمق علمي في الأصول والفقه، ووجود مناهج تعليمية تضمن وجود فقهاء ،مجتهدين، ولأجل القيام بمهمة تخريج أحكام الفروع والنوازل وفق ست أدوات رئيسة، كما وتوصلت إلى عدم نجاح محاولات إحداث مذهب فقهي جديد ؛ لأنها إما محاولات تستند إلى مخالفة القواطع والإجماع، والأخذ بما يخالف الكتاب والسنة، وإما محاولات لم تستكمل البنية الذاتية للمذهب الفقهي، واعتمدت على مبررات غير موضوعية. وتوصي الدراسة بدراسة أسباب تطور الاختيارات الفقهية في المذاهب الأربعة، ودراستها دراسة تحليلية، وتفعيل الاستفادة من أدوات الاجتهاد في المذاهب الأربعة في معالجة النوازل المعاصرة، ومناقشة الشبهات والإيرادات على المذاهب الفقهية والتمذهب.

This research addresses the creation of a new jurisprudential school of thought based on the four schools of thought: the reasons for its difficulty and its most prominent attempts. The study used the inductive approach in collecting scientific materials and the analytical approach in analyzing it. The study concluded that the criterion for creating a new jurisprudential school of thought is to create a jurisprudential approach, independent from the four schools of thought, producing branches of jurisprudence. The study also concluded that it was difficult to create a jurisprudential school of thought for three reasons: The first reason: the difficulty to come up with new fundamentals in form and content. The second reason: There are limits to the jurisprudential independent reasoning and the inability to disagree with consensus of the jurists. The third reason: The adequacy of the four schools of thought in carrying out the tasks of independent reasoning in terms of fundamental and application, and there is no need for others, because of the stability of the fundamentalism rules and methods of independent reasoning, and because of the existence of scientific depth in fundamentals and jurisprudence, and the existence of educational curricula that guarantee the presence of diligent jurists, and for carrying out the task of inferencing the rulings of the branches and contemporary issues according to six main tools. It also concluded that attempts to create a new jurisprudential school of thought were not successful, because they are either attempts based on disagreeing with the evidences and consensus of the jurists, and adopting what contradicts the Qur'an and Sunnah, or attempts that did not complete the internal structure of the jurisprudential school of thought, and relied on non-objective justifications. The study recommends studying the reasons for the development of jurisprudential choices in the four schools of thought, activating the benefit of jurisprudential sayings in addressing contemporary issues, the need to study jurisprudential abbreviations in an analytical study, and discussing the doubts and implications of the jurisprudential schools of thought.
