|a لما كانت الجهة الموقوف عليها (مصرف الوقف) ركناً من أركان الوقف، كان له مزيد عناية في أحكام الشريعة، سواء أكان ذلك من خلال ضبطها وتحديدها وبيانها بياناً يزول معه كل لبس وغموض، أم من حيث بيان أحكام تغيير تلك المصارف بعد استقرارها ابتداءً، لما قد يظهر من ضرورة أو مصلحة أو تفسير لشرط واقف، ومن هنا جاءت فكرة (أحكام تغيير مصرف الوقف.. دراسة فقهية تأصيلية) لبيان مقتضيات تغيير مصرف الوقف وموجباته من جهة، ثم ما يتبع ذلك من ضوابط وأحكام فقهية إجرائية ترافق عملية تغيير مصرف الوقف من جهة أخرى، ثم ربط ذلك كله بمقاصد التشريع عمومًا ومقاصد الشريعة في الوقف خصوصاً، وكذلك نماذج تطبيقية سواء أكان من واقع وحالة بعض الأعيان الموقوفة أم من واقع أحكام وعمل القضاء وواقع التشريعات والتنظيمات القضائية، وصولاً للإجابة عن السؤال الأهم وهو: هل أحكام الشريعة الإسلامية تملك الاستجابة والقدرة لمعالجة قضايا الوقف المختلفة؟، ومنها: (تغيير مصرف الوقف) بما يحقق الثمرة العملية المرجوة من الوقف.
|b Since the channels of expenditure (the waqf beneficiary) is a fundamental pillar of the waqf, it requires special attention in Sharia provisions. This involves clearly defining and regulating the beneficiary to remove any ambiguity or confusion. Additionally, it includes outlining the rules for changing these beneficiaries after their initial establishment due to necessity, benefit, or interpretation of the endower's conditions. The concept of "The Provisions on Changing the Beneficiary of a Waqf: An Authentic Jurisprudential Study" was developed to clarify the requirements and justifications for altering the waqf beneficiary in one hand and addresses the procedural and jurisprudential rules that accompany such changes, in second hand, linking them to the broader objectives of Islamic legislation and the specific purposes of waqf. Furthermore, it includes practical examples from real cases of endowed properties, judicial rulings, and legislative frameworks. Ultimately, it seeks to answer the crucial question: Does Islamic Sharia have the responsiveness and capability to process various waqf issues, including (changing the waqf beneficiary), to achieve the intended practical benefits of the waqf?
