المستخلص: تتناول الدراسة أحكام المسؤولية المدنية عن أضرار المركبات ذاتية القيادة في إمارة دبي، وذلك وفقا للقانون الصادر مؤخرا في الإمارة رقم 9 لسنة 2023 بشأن تنظيم تشغيل المركبات ذاتية القيادة في إمارة دبي. حيث تم تقسيم الدراسة إلى مبحثين، يتناول الأول منهما ماهية المركبات ذاتية القيادة وشروط ترخيصها في الإمارة، حيث أن القانون المذكور قد بين ماهية المركبات ذاتية القيادة بشيء من التفصيل والتحديد، كما أوجب توافر عدد من الشروط اللازمة لترخيص المركبة في الإمارة. أما المبحث الثاني، فقد خصص لبيان مسؤولية المشغل عن أضرار المركبات ذاتية القيادة، حيث أن المادة 14 من القانون قد نصت صراحة على مسؤولية المشغل عن كافة الأضرار التي تلحق بالأفراد أو الممتلكات بسبب المركبة ذاتية القيادة، وهو ما يستوجب البحث في تحديد ماهية المشغل من جهة، وبيان أحكام المسؤولية الواقعة على عاتقه والإشكاليات الواردة بشأنها. وقد أشادت الدراسة بأهمية القانون رقم 9 لسنة 2023 وفعاليته، مع إيراد بعض التوصيات والتعديلات المقترحة بخصوص مسؤولية المشغل، ومدى إمكانية تحديد المسؤول الحقيقي عن الأضرار، كما أوصت الدراسة بعدم الاكتفاء بالقوانين المحلية لتنظيم أحكام المسؤولية المدنية الناجمة عن أضرار المركبات ذاتية القيادة، وضرورة سن تشريع اتحادي يشمل كافة إمارات الدولة في هذا الشأن.

The study addresses the provisions of civil liability for damages to autonomous vehicles in the Emirate of Dubai, in accordance with the recently issued Law No. 9 of 2023 in the Emirate regulating the operation of autonomous vehicles in the Emirate of Dubai. The study was divided into two sections, the first of which deals with the nature of self-driving vehicles and the conditions for licensing them in the emirate, as the aforementioned law explained the nature of self-driving vehicles in some detail and specificity, and also required the availability of a number of conditions necessary for licensing the vehicle in the emirate. As for the second section, it was devoted to clarifying the operator’s responsibility for damages to self-driving vehicles, as Article 14 of the law explicitly stipulates the operator’s responsibility for all damages caused to individuals or property caused by the self-driving vehicle, which requires research into determining the identity of the operator on the one hand, An explanation of the provisions of the responsibility he bears and the problems arising therefrom. The study praised the importance of Law No. 9 of 2023 and its effectiveness, while providing some recommendations and proposed amendments regarding the operator’s responsibility and the extent to which it is possible to determine who is truly responsible for the damages. The study also recommended that local laws should not be limited to regulating civil liability provisions resulting from damages to self-driving vehicles, and the necessity of enacting federal legislation. It includes all the emirates of the country in this regard.
