المستخلص: وفقا لما ذهب إليه أكثر العلماء من أن التجديد في الدين يشمل التجديد في الدين كله، كما يشمل التجديد في بعض أجزائه، يلقي هذا البحث الضوء على التجديد الفقهي عند الإمام ابن القيم رحمه الله، وقد اعتنى البحث بإبراز أهمية وضرورة التجديد الفقهي في عصر ابن القيم، وأهداف ووسائل التجديد الفقهي عنده، كما وجه الباحث جل البحث لدراسة أبرز قضايا التجديد الفقهي عند ابن القيم. واختار الباحث ابن القيم محورا للدراسة لما لاح له من أوجه تشابه بين عصره وعصرنا، فيسهل استنساخ قضايا التجديد في واقعنا المعاصر. كما اتبع الباحث في بحثه المنهج الوصفي، والتاريخي، والاستنباطي، والتحليلي بعملياته المتعددة؛ للخروج بنتائج سليمة يمكن الاستفادة منها في عصرنا هذا. هذا وتوصل الباحث من خلال بحثه إلى نتائج أهمها: أن أبرز ملامح التجديد الفقهي عند ابن القيم رحمه الله تتلخص في: جهوده رحمه الله في إحياء منهج السلف في الفقه والإفتاء، ومحاربة التعصب والتقليد، وإبطال الحيل؛ صونا لحياض الشريعة، كما تتجلى ملامح التجديد عنده في جهوده في توسيع دائرة البينات ووسائل الإثبات، والعقود والمعاملات، وفي اعتبار سد الذرائع، وتوسيعه لباب التعزيرات بتبنيه العقوبات المالية، ومما تميز له منهجه التجديدي إعادته النظر في كثير من القواعد التي كانت تعامل معاملة المسلم به، وبناؤه الأحكام على الأعراف والعوائد، والأزمان والأحوال.

According to the opinion of the majority of the scholars that renewal in religion includes renewal in the whole religion, and it also includes renewal in some of its parts, this research sheds light on the jurisprudential renewal according to Imam Ibn al-Qayyim -may Allah have mercy on him-. The research focused on highlighting the importance and necessity of jurisprudential renewal in the era of Ibn al-Qayyim, and the objectives and means of jurisprudential renewa, as the researcher also dedicated most of the research to studying the most prominent issues of jurisprudential renewal according to Ibn al-Qayyim. The researcher chose Ibn al-Qayyim as the cynosure of the study because of the similarities between his time and ours, facilitating the reproduction of issues of renewal in our contemporary reality. In his research, the researcher followed the descriptive, historical, deductive, and analytical approach with its multiple processes to come up with sound results that can be used in our time. The researcher concluded through his research on certain findings, the most significant of which include: That the most prominent features of jurisprudential renewal according to Ibn al-Qayyim, may Allah have mercy on him, are summarized in: his efforts, Allah have mercy on him, in reviving the approach of the predecessors in jurisprudence and fatwa, fighting fanaticism and imitation, and invalidating tricks, in order to preserve the neutrality of Sharia, as reflected in the features of renewal in his efforts to expand the circle of evidence and means of proof, contracts and transactions, and in considering blocking means to the prohibited, and expanding the pace of undefined punishments by adopting financial penalties, and what distinguished him in his renewal approach is his reconsideration of many rules which were treated as as trite, and premising rulings on customs, returns, times and conditions.
