المستخلص: لا يخفى على أحد ما تعيشه البشرية من تطور تكنولوجي هائل وحياة رقمية غير مسبوقة وغير متناهية بما يمدنا به هذا التطور من جديد على مدار اليوم الواحد، ومن ثمرات هذا التطور ومستجداته تقنيات الذكاء الاصطناعي التي أصبحت من الضرورات الأساسية التي لا يمكن الاستغناء عنها، أو تجاهلها، بل فرضت نفسها علينا بما يستوجب التعامل معها ومسايرتها لنلحق بركب البشرية السريع والاستفادة منه وإلا صرنا في مؤخرة الدول. فلا يستطيع أحد أن ينكر تدخل الذكاء الاصطناعي بتقنياته المختلفة في شتى مجالات الحياة الثقافية والاجتماعية والاقتصادية والعسكرية والعلمية، بما تقوم به من مهام يعجز العقل البشري عن القيام بها بدءاً من تيسير التواصل بين بني البشر في شتى أرجاء المعمور مروراً بتدخلها القوي في إنجاز الأعمال الرقمية والحسابية إلى جانب دورها الكبير في المجال الصناعي بكل أشكاله. وهذا التدخل القوي والفعال لتقنيات الذكاء الاصطناعي في مناحي الحياة المختلفة على هذا النحو أدى إلى نشأة العديد من العلاقات بينها وبين الأشخاص، مما أثار العديد من التساؤلات حول آثار هذه العلاقات وخاصة ما ينشأ عنها من حقوق والتزامات، وما قد يترتب عليها من مسئوليات وتعويضات، ومن يتحملها سواء عن تقنيات الذكاء الاصطناعي أو لها؟ وهل يمكن أن تتحمل هذه التقنيات هذه الآثار، وهل يمكن الاعتراف لها بالشخصية القانونية حتى تترتب لها هذه الآثار أو عليها؟ وهل تسعفنا النصوص والقواعد القانونية السارية في ذلك؟ من هنا جاءت فكرة هذا البحث للوقوف على طبيعة تقنيات الذكاء الاصطناعي لبيان مدى الاعتراف بالشخصية القانونية لهذه التقنيات ونطاقها للوقوف على مصير آثار ما تنشئه هذه التقنيات من علاقات قانونية مع الغير.

It is no secret to anyone that mankind is experiencing tremendous technological development and an unprecedented and endless digital life, with what this development provides us with again throughout one day, and among the fruits of this development and its developments are artificial intelligence techniques that have become one of the basic necessities that cannot be dispensed with, or ignored. Rather, it imposed itself on us in a manner that necessitates dealing with it and keeping pace with it so that we can catch up with the fast track of humanity and benefit from it, otherwise we will be at the back of the states. No one can deny the interference of artificial intelligence with its various technologies in various fields of cultural, social, economic, military and scientific life, with the tasks it performs that the human mind is unable to perform, starting from facilitating communication between human beings in all parts of the globe through its strong intervention in the completion of digital and computational works In addition to its great role in the industrial field in all its forms. This strong and effective intervention of artificial intelligence techniques in various aspects of life in this way led to the emergence of many relationships between them and people, which raised many questions about the effects of these relationships, especially the rights and obligations arising from them, and the responsibilities and compensation that may result from them, and from Incurred whether for artificial intelligence techniques or for her? Can these technologies bear these effects, and can they be recognized as legal persons in order for them to have these effects or upon them? Do the applicable legal texts and rules help us with that? From here came the idea of this research to find out the nature of artificial intelligence techniques to show the extent of recognition of the legal personality of these technologies and their scope to determine the fate of the effects of what these technologies create in legal relations with others.
