|a إن الأحكام الشرعية لا تنفك عن ملازمة مقاصد الشريعة الغراء، فمقاصد الشريعة العامة وقواعدها الكلية ضابطة للأحكام الشرعية، لتؤتي الثمار المتوخى تحقيقها من ذلك التشريع، تحقيقا لمصالح العباد والبلاد، ودرءا للمفاسد التي تحيق بهم جراء مخالفة الأحكام الشرعية. وقد تناولت الدراسة سورة النساء لبيان كيفية تحقيقها مقصد العدل مع النساء، وهن أشد فئات المجتمع الجاهلي استضعافا، وقد هدفت إلى بيان مضامين العدل التي كمنت في بواطن ما تم تشريعه لهن من أحكام مالية واجتماعية، بنت في ثنايا السورة التي عنيت بشأنهن وسميت بهن، كما لم تعن سورة أخرى في القرآن الكريم، وخلصت إلى أن السورة الكريمة بتشريعاتها الربانية قد حققت للنساء مقصد العدل سواء على صعيد حقوقهن المالية أو حقوقهن الاجتماعية على نحو كامل لا كمال بعده، من غير إجحاف بحقوق الرجال، فجاءت أحكامها متوازنة مع الطرفين.

The purposes of the general Sharia, and its general rules, control the Sharia provisions. to bear the fruits required by that legislation, In order to achieve the benefits of the people and the countries, and to ward off the evils that befall them as a result of violating the legal provisions. The study dealt with Surah An-Nisa to show how it achieves the purpose of justice with women, who are the most vulnerable groups in pre-Islamic society, It aimed to clarify the contents of justice that lay within the financial and social provisions that were legislated for them. It was spread within the folds of the surah that was intended and named of them, just as no other surah in the Holy Qur’an meant it, It concluded that the Noble Surah, with its divine legislation, has achieved the purpose of justice for women, whether in terms of their financial rights or their social rights, in a complete and incomplete way, without prejudice to the rights of men, so its provisions were balanced with both parties.
