|a يقصد هذا البحث إلى دراسة حمل اليمين على العرف وتطبيقاته الفقهية، وبيان أقوال الفقهاء في حكم حمل اليمين على العرف والحكم إذا تعارض اللفظ بين اللغة والعرف، وشروط العرف المعتبر شرعا، وعرض بعض التطبيقات الفقهية لحمل اليمين على العرف عبر اتباع المنهج الوصفي الاستقرائي والتحليلي. وهذه من الدراسات التي لابد من العناية بها؛ لأهميتها في كون العرف معتبرا في اليمين وفقا لضوابط الشرع؛ لمراعاة مصالح الناس، ولرفع الحرج عن المكلف عند الخلط بين المعاني العرفية في اليمين. ليخلص القارئ إلى أن العام والمطلق يحمل على المعنى الذي جرى عرفهم باستعماله فيه، وأنه إذا غلب استعمال الاسم العام حتى صار حقيقة عرفية فيعمل العرف، فهذا لا يدخل في العموم، وأن شيوع الاستعمال للفظ يجعله معتبرا، كونه واضح الدلالة للجميع دون لبس، وأنه لكي يكون العرف معتبرا شرعا وتترتب عليه الأحكام لابد ألا يخالف النصوص الشرعية ولا يخالف أيضا قواعد الشريعة، وأن يجري العمل به، ويعتاده الناس في أعرافهم. وأوصي بزيادة العناية بدراسة المتعلقات بالعرف؛ باعتباره قاعدة فقهية وقانونية يعمل بها.
|b This research aims to study the obligation of an oath to be based on norms and its jurisprudential applications and to explain the thoughts of jurists regarding the ruling on making an oath to be based on norms, the ruling if the wording conflicts between language and norms, the conditions of the norms considered legally, and to present some jurisprudential applications of making an oath to be based on norms by following the descriptive, inductive and analytical approach. This is one of the studies that must be taken care of. Because of its importance in that norms is considered in oath-taking in accordance with Sharia law, to take into account the interests of the people, and to relieve the embarrassment of the accountable person when confusing the customary meanings of the oath. So that the reader can conclude that the general and the absolute carry the meaning in which they were known to use it, and that if the use of the general noun prevails until it becomes a customary fact and the norms is applied, then thi s does not fall within the generality. The widespread use of a word makes it considered, as it is clear in meaning to everyone without ambiguity, and that in order for a custom to be considered legally and for rules to follow, it must not contravene the legal texts or also violate the rules of the Sharia, and it must be implemented, and people become accustomed to it in their customs. I recommend that more attention to be paid to studying matters related to norms, as a jurisprudential and legal rule by which it operates.
