|a يهدف هذا البحث إلى الإجابة عن ثلاثة أسئلة، وهي: السؤال الأول: هل يوجد فرق بين الشرط وعدم المانع؟ السؤال الثاني: ما هو الفرق بين الشرط وعدم المانع إن قيل بالفرق بينهما؟ السؤال الثالث: ما هو أثر الفرق بين الشرط وعدم المانع في الأصول والفروع؟ وقد تم التمهيد للبحث ببيان معنى الشرط والمانع في اللغة واصطلاح الأصوليين. ثم تناول البحث موضوع الدراسة في مبحثين، تم في المبحث الأول معالجة موضوع الفرق بين الشرط وعدم المانع في مطلبين، فكان بيان الخلاف في التفريق بين الشرط وعدم المانع في المطلب الأول، ثم في المطلب الثاني بينت أوجه الجمع والفرق بين الشرط وعدم المانع في مسألتين، الأولى: في بيان أوجه الجمع بين الشرط وعدم المانع، والمسألة الثانية في بيان أوجه الفرق بين الشرط وعدم المانع. وأما المبحث الثاني فقد تناول أثر التفريق بين الشرط وعدم المانع، وكان ذلك في مطلبين: الأول: في أثر التفريق بين الشرط وعدم المانع في أصول الفقه، والمطلب الثاني: أثر التفريق بين الشرط وعدم المانع في الفقه.
|b This research aims to answer three questions: The first question: Is there a difference between a condition and non preventive? The second question: What is the difference between a condition and non preventive, if it is said that there is a difference between them? The third question: What is the effect of the difference between the condition and non preventive in the principles and subsidiary? The research was prefaced by explaining the meaning of condition and no preventive in the language and terminology of the principles of jurisprudence. Then the research dealt with the subject of the study in two sections. In the first section, the topic of the difference between condition and non preventive was addressed in two topics. The disagreement was explained in the distinction between condition and non preventive in the first requirement. Then in the second topic, aspects of the combination and difference between condition and non preventive were explained in two issues. The first: in explaining the aspects of combining the condition and non preventive , and the second issue in explaining the aspects of the difference between the condition and non preventive. As for the second topic, it dealt with the distinction between the condition and non preventive of an obstacle, and that was in in two topics: The first: On the effect of the distinction between the condition and non preventive of an obstacle in the principles of jurisprudence , and the second topic: The effect of the distinction between the condition and non preventive of an obstacle in jurisprudence.
