المستخلص: يدور البحث في الضوابط الواجب توافرها لاستثمار أموال الأوقاف، وربط هذه الضوابط بأقوال الفقهاء المتقدمين، وحدوده الفقرة التاسعة من القرار ذي الرقم ١٤٠ (٦/15) من قرارات الدورة الخامسة عشرة لمجلس مجمع الفقه الإسلامي الدولي. وهدفه الوقوف على الضوابط المشار إليها للتعريف بها، وتأصيلها فقهياً، وبيان عظم الشريعة الغراء ومرونتها في ذلك، ومنهجه: استقرائي تحليلي. وجاء في تمهيد وخمسة مباحث، وأهم نتائجه: أن القرار يعمل بأصول الشريعة التي ترغب في الاحتياط في العبادات والمعاملات على حد سواء، ومن ذلك الاحتياط في الاستثمار في أموال الأوقاف، والحذر من أن يكون الاستثمار جارياً على الظن أو الاحتمالات. ومن توصياته العمل لإعداد دراسة أوسع لضوابط استثمار أموال الأوقاف من علماء الشرعية والاقتصاد، ومن العاملين الممارسين في القطاع الوقفي، والوصول إلى توصيات عملية تنفيذية تختص باستثمار أموال الأوقاف، تشرف عليها وتنفذها الجهات الرقابية للأوقاف.

This research discusses the necessary controls for investing endowment funds and link these controls with the sayings of the previous jurists, and its borders: the ninth paragraph of Resolution No. 140 (6/15) of the decisions of the fifteenth session of the Council of the International Islamic Jurisprudence Academy. Its problem is answering the question: What is the jurisprudential rooting of the controls and its goal? for identification of the above-mentioned controls and rooting them jurisprudentially, as well as explanation the greatness and flexibility of Sharia law in this regard, and its approach is inductive and analytical. It includes an introduction and five sections, and one of its most important results is that the decision is depends on the principles of Sharia law, which encourage reservation in both worship and transactions, and this reservation includes investing in endowment funds, and caution that investment should be based on suspicion or possibilities. The recommendations: working on a wide study of the controls for investing endowment funds from scholars of Sharia and economy, and practicing workers in the endowment sector, and working on the recommendations for an executive process which is related to investing endowment funds, as well as supervised and implemented by the endowment regulatory authorities.
