|a هذا وبالله التوفيق قد اخترت بحثا موسوما ب: (حكم عزل المحكم ونفاذ أحكامه ونقضها في الفقه الإسلامي) هذا ولقد قسمت هذا البحث إلى مبحثين: المبحث الأول: تناولت فيه ماهية التحكيم ومشروعيته ومزاياه وتعيين المحكم وآراء الفقهاء في ما يجوز للمحكم أن يحكم فيه وما لا يجوز. المبحث الثاني: تناولت فيه حجية حكم المحكم ونفاذ أحكامه وعزله ونقض أحكامه. ثم أنهيت بحثي بخاتمة تناولت فيها أهم النتائج والتوصيات الخاصة به. وذكرت قائمة بأهم المراجع والمصادر التي استندت إليها في كتابة هذا البحث. ثم أنهيت البحث بفهرس يتضمن الموضوعات التي تناولتها، هذا والله أسأل التوفيق والسداد، إنه تعالى نعم المولى ونعم النصير.
|b This research entitled: (The Ruling on the Dismissal of the Arbitrator and the Enforcement of his Rulings and their Annulment in Islamic Jurisprudence) is divided into two sections as following: The first section discussed the nature of arbitration, its legitimacy and advantages, the appointment of the arbitrator, and the opinions of jurists on what the arbitrator may rule on and what may not. The second section examined the validity of the arbitrator's ruling, the enforcement of his rulings, dismissal, and the annulment of his rulings. This research was concluded by addressing the most important results and recommendations of this research. Then a list of the most important references and sources was mentioned, and an index that includes the topics addressed in this research was concluded.
