المستخلص: تهدف دراسة هذا البحث لأحد المستجدات المعاصرة في المجال الطبي وهي ما يتطلع إليه الأطباء من استنبات الغدد التناسلية للإنسان، حيث تعالج مشكلة العقم وعدم الإنجاب، فكان لا بد من إلقاء الضوء عليها ودراستها من الناحية الطبية والفقهية وبيان الحكم الفقهي الخاص بهذه النازلة، خاصة لما يتعلق بها من أحكام تتعلق بالأنساب. وقد اتبعت في كتابة هذا البحث المنهج الاستقرائي القائم على الاستقراء وتتبع الجزئيات، والمنهج المقارن الذي يعتمد على المقارنة. ويهدف البحث إلى الإجابة عن هذا التساؤل: ما مفهوم الاستنبات والمقصود بالغدد التناسلية، وما الغرض من استنباتها، وعلاقتها بمسألة النسب، وما العلاقة الطبية والفقهية بمسألة استنبات الغدد التناسلية، وما حكم النسب الناتج عن استنبات الغدد التناسلية، ومدى أثره على اختلاط الأنساب سواء كان الاستنبات بغرض غرسها في أجساد المرضى المحتاجين إليها كعلاج، أو إذا كان الغرض من استنباتها في جسد الرجل العقيم أو المرأة العاقر ليتمكنا من الإنجاب سواء في حال استنبات ما تنتقل به الخصائص الوراثية للإنسان- وهما الخصية أو المبيض-ومصنعين من خلايا نفس الشخص، أو وأما في حال استنبات ما تنتقل به الخصائص الوراثية للإنسان ومصنعين من خلايا شخص آخر.

The study of this research aims to be one of the contemporary developments in the medical field, which is what doctors aspire to in cultivating human reproductive glands, as it addresses the problem of infertility and lack of children. It was necessary to shed light on it and study it from a medical and jurisprudential standpoint, and to state the jurisprudential ruling on this calamity, especially with regard to what relates to it. It contains provisions related to lineage. In writing this research, I followed the inductive approach based on extrapolation and tracking of details, and the comparative approach based on comparison. The research aims to answer this question: What is the concept of cultivation and what is meant by reproductive glands, what is the purpose of cultivating them, and its relationship to the issue of lineage, and what is the medical and jurisprudential relationship to the issue of reproductive gland cultivation, and what is the ruling on lineage resulting from reproductive gland culture, And the extent of its effect on the mixing of lineages, whether the cultivation was for the purpose of implanting it in the bodies of patients who need it as a treatment, or if the purpose of cultivating it in the body of a sterile man or sterile woman was to enable them to have children, whether in the case of cultivation of what carries the genetic characteristics of a person - namely the testicle or the ovary - and they are manufactured. From the cells of the same person, or in the event that what carries the genetic characteristics of a person is cultured and manufactured from the cells of another person.
