المستخلص: أضحت تقنية البلوك تشين محور اهتمام واسع نظرا لقدرتها الهائلة على تأمين البيانات بشكل لامركزي، مما يعزز الشفافية والأمان في التعاملات الإلكترونية، وتعتمد هذه التقنية على نظام تشفير متقدم ينظم البيانات في سلاسل مترابطة، ما يجعلها أداة فعالة لتوثيق العقود، خصوصا العقود الذكية التي تتيح تنفيذ الالتزامات التعاقدية بشكل ذاتي دون الحاجة إلى وسطاء. والعقود الذكية التي تعتمد على تقنية البلوك تشين، تمثل تحولا جذريا في العقود الإدارية، حيث تقدم حلولا مبتكرة لتحسين الكفاءة وتقليل المخاطر المرتبطة بالتحايل أو التأخير أو الفساد، فهي توفر بيئة موثوقة وشفافة لتنفيذ الشروط التعاقدية بشكل تلقائي، مما يسهم في تسريع الإجراءات وحماية الحقوق المتعاقد عليها، ما يجعلها أداة حيوية لتطوير العقود الحكومية. وعلى الرغم من المزايا العديدة لتطبيق العقود الذكية في العقود الإدارية، إلا أن هناك تحديات قانونية وتنظيمية تتعلق بإطارها التشريعي، فضلا عن التحديات التقنية والمجتمعية المرتبطة بقبول هذه التقنية. ومن هنا، تتطلب مواجهة هذه التحديات تدخلا حكوميا لتعديل التشريعات القائمة وتطوير البنية التحتية الرقمية اللازمة لضمان نجاح تطبيق هذه التقنية في إدارة العقود الحكومية بكفاءة وفعالية. وتتجلى أهمية البحث في تسليط الضوء على أهمية تقنية البلوك تشين والعقود الذكية ودراسة إمكانية إدماجها ضمن الإطار القانوني للعقود الحكومية، تماشيا مع التوجه نحو الرقمنة في الإجراءات الإدارية. وقد تم استخدام المنهج الوصفي التحليلي والمقارن عند إعداد هذا البحث. لذلك جاء البحث بعنوان: أثر العقود الذكية المبرمة عبر تقنية البلوك تشين على تطوير العقود الإدارية: دراسة تحليلية مقارنة"، وتناولته من خلال مقدمة، ومبحثين، وخاتمة. أما المبحث الأول، فتناولت فيه: مفهوم تقنية البلوك تشين، ومفهوم العقود الذكية. والمبحث الثاني، فقد ذكرت فيه: دور العقود الذكية في تطوير العقود الإدارية والإطار التشريعي الناظم لها، والتحديات في تبني العقود الذكية للعقود الإدارية وكيفية التغلب عليها. ثم اختتمت بحثي بما توصلت إليه من نتائج وتوصيات.

The blockchain technology has become the focus of widespread attention due to its enormous capacity for securing data in a decentralized manner, which enhances transparency and security in electronic transactions. This technology relies on an advanced encryption system that organizes data into interconnected chains, making it an effective tool for documenting contracts, particularly smart contracts, which allow for the automatic execution of contractual obligations without the need for intermediaries. Smart contracts based on blockchain technology represent a radical transformation in administrative contracts, offering innovative solutions to improve efficiency and reduce the risks associated with fraud, delays, or corruption. They provide a reliable and transparent environment for the automatic execution of contractual terms, contributing to the acceleration of procedures and the protection of contractual rights, making them a vital tool for the development of government contracts. Despite the many advantages of applying smart contracts to administrative contracts, there are legal and regulatory challenges related to their legislative framework, as well as technical and societal challenges regarding the acceptance of this technology. Therefore, addressing these challenges requires governmental intervention to amend existing legislation and develop the necessary digital infrastructure to ensure the successful implementation of this technology in managing government contracts efficiently and effectively. The importance of this research lies in highlighting the significance of blockchain technology and smart contracts and exploring the possibility of integrating them within the legal framework of government contracts, in line with the trend toward digitization in administrative procedures. The descriptive, analytical, and comparative methods were used in preparing this research. Therefore, the research was titled: "The Impact of Smart Contracts Concluded via Blockchain Technology on the Development of Administrative Contracts: A Comparative Analytical Study," and it was addressed through an introduction, two sections, and a conclusion. The first section addressed the concept of blockchain technology and the concept of smart contracts. The second section discussed the role of smart contracts in developing administrative contracts, their regulatory legislative framework, and the challenges in adopting smart contracts in administrative contracts, along with ways to overcome them. The research was concluded with the findings and recommendations.
