|a هدفت هذه الدراسة إلى بيان أثر العرف في عقود التبرعات: الهبة والوصية والوقف وقد سلكت الدراسة المنهج الوصفي مع الاستعانة بالمنهجين الاستقرائي والتحليلي. وركزت الدراسة على إبراز مفهوم العرف والأدلة على حجيته من القرآن الكريم والسنة النبوية الشريفة والآثار الواردة عن الصحابة والتابعين كما أنها ركزت على بيان مفهوم عقود التبرعات بشكل عام. وأفردت الدراسة ثلاثة عناوين مهمة وبينت الدراسة أثر العرف على عقد التبرع مع توضيح بعض التطبيقات المعاصرة في الموضوع وكذلك الأمر بأثر العرف على الهبة والوقف والوصية وتطرقت إلى بعض النماذج المعاصرة والتي تتحدث عنها بشكل جلي وواضح. وتوصلت الدراسة إلى أن العرف يتغير حسب الزمان والمكان لحكمة ربانية، وهذا إن دل على شيء فإنه يدل على صوابية الشريعة الإسلامية، وأنه إلى جانب مصادر التشريع المعروفة القرآن الكريم والسنة النبوية والاجتهاد والقياس، فإنه يعتد بالعرف كأحد مصادر التشريع التي يلجأ إليها عند الحديث عن الأحكام الشرعية ولا سيما المعاصرة.
|b The aim of this study was to demonstrate the impact of custom in donation contracts: gift, will and endowment. the study followed the descriptive approach with the use of inductive and analytical methods. The study focused on highlighting the concept of custom and the evidence of its authenticity from the Holy Qur'an and the Sunnah of the prophet, and the effects received from the companions and followers, and it also focused on explaining the concept of donation contracts in general. The study highlighted three important headings, and the study showed the impact of custom on the donation contract while clarifying some contemporary applications in the subject, as well as the impact of custom on the gift, endowment and will, and touched on some contemporary models that speak about them clearly and clearly. The study found that the custom changes according to time and place for the wisdom of the Lord, and this, if anything, indicates the correctness of the Islamic Sharia, and that in addition to the well-known sources of legislation, the Holy Quran, the Sunnah of the Prophet, Itihad and Qiyas, it counts the custom as one of the sources of legislation resorted to when talking about the legal provisions, especially contemporary.
