|a تهدف هذه الدراسة إلى بيان مفهوم القصاص في اللغة العربية والشريعة الإسلامية وإثبات مشروعية عقوبة القصاص من القرآن الكريم والسنة النبوية وإجماع فقهاء الأمة والدليل العقلي. والتأكيد على أن لعقوبة القصاص في فقه العقوبات الإسلامي شروطا وأحكاما، ثم مقارنة تطبيق عقوبة القصاص في الفقه الإسلامي وقانون العقوبات الأردني كدراسة مقارنة، وقد أثبتت الدراسة أن تطبيق عقوبة القصاص في فقه العقوبات الإسلامي تحقق العدالة أكثر من قانون العقوبات الأردني.
|b This study aims to explain the concept of retaliation in the Arabic language and Islamic law, and to prove the legitimacy of the punishment of retaliation from the Holy Qur’an, the Sunnah of the Prophet, the consensus of the nation’s jurists, and rational evidence. Emphasizing that the punishment of retaliation in Islamic penal jurisprudence has terms and conditions, then comparing the application of the punishment of retaliation in Islamic jurisprudence and the Jordanian Penal Code as a comparative study. The study has proven that the application of the punishment of retaliation in Islamic penal jurisprudence achieves justice more than the Jordanian Penal Code.
