المستخلص: كي تتحقق القيمة العلمية لأي بحث أكاديمي أصيل لابد من الاستناد على عدة مراجع ومصادر كنوع من الاطلاع على ما سبق دراسته حول موضوع البحث وذلك من خلال اعتماد مهارات الاقتباس والتوثيق الصحيح، إلا أن مسألة الاقتباس تتطلب قبل كل شيء احترام عدة معايير ومبادئ تسهم في نهاية المطاف إلى تحقيق ما يسمى بالنزاهة العلمية، في مقابل تفادي إفقاد البحث قيمته العلمية وهو ما يعرف آنذاك بالسرقة العلمية. وعليه فإن موضوع دراستنا تتلخص في الأحكام التي جاء بها القرار رقم 1082 لإضفاء نوع من الحماية لمختلف الأبحاث العلمية التي تتعرض دائم الظاهرة السرقة العلمية، ومنه السعي وراء وضع حد لهذا النوع من التجاوزات وذلك من خلال فرض عقوبات صارمة وتوقيع العديد من الجزاءات على مرتكبيها بهدف التصدي لها سواء كانوا هؤلاء الباحثين من فئة الطلاب أو فئة الأساتذة.

In order to achieve the scientific value of any original legal research, it is necessary to rely on several references and sources as a kind of familiarization with what has already been studied on the subject of research by adopting the skills of quotation and correct documentation. However, the issue of quoting requires above all the respect of several criteria and principles that ultimately contribute to the achievement of the so-called scientific integrity, in return for avoiding the loss of research of its scientific value, which is known at the time as scientific theft, which is the subject of our article. Accordingly, Resolution No. 1082 came to protect scientific research from the phenomenon of scientific theft and to put an end as many penalties imposed on the perpetrators as a kind of countering them.

Pour atteindre la valeur scientifique de toute recherche universitaire authentique, il est nécessaire de s’appuyer sur un certain nombre de références et de sources comme une sorte d’aperçu de ce qui a déjà été étudié sur le sujet de la recherche en adoptant descompétences correctes en matière de citation et de documentation. Mais, surtout, la question de la citation exige le respect de plusieurs normes et principes qui contribuent à terme à l’atteinte de ce qu’on appelle l’intégrité scientifique, en échange d’éviter la perte de la valeur scientifique de la recherche, ce qui est alors connu comme vol scientifique. Le sujet de notre étude est donc résumé dans les dispositions du décret no. 1082 pour assurer une certaine protection aux diverses recherches scientifiques qui ont toujours été soumises au phénomène du vol scientifique. s Droits", qui vise à mettre fin à de tels abus en imposant des sanctions sévères et nombreuses contre les auteurs afin de s’y attaquer, que ces chercheurs soient étudiants ou professeurs.
