المستخلص: دأب العلماء والمؤرخون إلى الاعتماد على النوازل الفقهية كمادة مصدرية هامة للتأريخ والبحث في حيثيات المجتمع المغربي الوسيط كفتاوى البرزليو الونشريسي، ولأن هذا الصنف من المصادر التاريخية يهتم بجوانب عديدة من الحياة الاجتماعية والاقتصادية والدينية والعلمية التي تستقى من الأسئلة التي تطرح على الفقهاء وحتى من الحلول التي أقروها، فإن هذه الدراسة تسعا إلى محاولة إبراز دور كتب النوازل في التأريخ لجميع مجالات الحياة حتى المهمشون منها، وكيفية استغلال المؤرخين المستشرقين منهم والمغاربة على حد سواء لهذه المادة التي ساعدتهم في تجاوز النقص المصدري الذي تعاني منه المصنفات التقليدية، وكيفية تعاملهم مع كتب الفتاوى والنوازل بطريقة منهجية تغربل المعلومات التاريخية الهامة، فبذلك أصبحت كتب النوازل الفقهية تشكل مصدرا مهما لكتابة التاريخ الاجتماعي والاقتصادي للغرب الإسلامي واهتمامنا بهذا الجانب وحرصنا على تناوله في هذه الورقة ينبع من جنوح وميل الباحثين لهذا الصنف المصدري الذي أصبح مرجعا أساسيا لمعظم الأطروحات الجامعية للبث في القضايا الاجتماعية والاقتصادية، في محاولة منا بالدرس والتحليل كيفية التناول والتخريج واستنتاج المعلومات المكنونة بين دفات النوازل.

Scolors and historians have always relied on jurisprudential nawazil as an important source material for chronicling and researching the merits of the Mediterranean Maghreb society, such as the religious advisory opinions of AL.Borzoli and AL.wancharisi. Because this category of the historical sources is concerned with different aspects of social, economic, religious and scientific life that are drived from the questions asked to jurists and even from the solutions they have endorsed, this study seeks to attempt to highlight both the role of nawazil books in chronicling all aspects of life, even the marginalized ones and how the Orientalist historians and Maghreb ones can exploit this material which helped them overcome the source deficiency that traditional works suffer from, and how they deal with the nawazil books of advisory religious opinions in a systematic way that filters the important historical information .Jurisprudential Nawazil books became an important source to write the social and economic histography of the Islamic west. Our care to this part in this paper is originated from the researcher's tendency to this category source that became an essential reference to most academic theses in order to propagate social and economic issues, traying to study and analise the way of talking, inferencing and deducing the hidden information in nawazil books.

Les chercheurs et les historiens se sont traditionnellement appuyés sur les Nawazil jurisprudentiels pour étudier l'Histoire et comprendre la société maghrébine médiévale, comme les fatwas d'Al-Barzali et d'Al-Wunshirisi, et comme ce type de sources historiques concerne de nombreux aspects de la vie sociale, économique, religieuse et scientifique qui découlent des questions posées aux juristes et même des solutions qu'ils ont approuvées, cette étude cherche à mettre en évidence le rôle des Nawazil dans l'histoire de tous les domaines de la vie, même ceux qui sont marginalisés, et comment les historiens, tant orientalistes que maghrébins ont utilisé ce matériel qui les a aidés à surmonter le déficit de sources, et comment exploiter ces sources pour analyser les informations historiques importantes. Les livres des fatwas et les Nawazil sont devenus une source important pour l'écriture de l'histoire sociale et économique du Maghreb islamique. Notre intérêt pour cet aspect et notre volonté de l'aborder découlent de la tendance et de l'inclination des chercheurs pour ce type de sources, qui sont devenues une référence essentielle pour la plupart des thèses universitaires sur les questions sociales et économiques. Dans cette étude, Nous avons étudié et analysé comment traiter, graduer et déduire l'information contenue dans les livres des Nawazil.
