|a النفقة من الحقوق المالية في عقد الزواج، فالزوج يكون ملزما بأدائها، لكن الفقهاء القدامى عند كلامهم على مشتملاتها لم يدرجوا نفقة العلاج والدواء ضمنها، بخلاف ما قال به الفقهاء المعاصرون حول إلزامية هذا النوع من النفقة، وفق تصور جديد فرضته متغيرات الحياة. والعقم مرض يكون علاجه بوسائل طبية تقليدية وأخرى مستحدثة، تتطلب بذل مصاريف معتبرة. وإذا كانت الزوجة هي العقيم، فهل يلزم الزوج بهذه النفقة؟ هذه الدراسة نحاول بمقتضاها تحديد مدى إلزامه بذلك، فقد خلصنا إلى أن نفقة العلاج بالطرق التقليدية تأخذ حكم الإلزام لعدم تحديد المشرع لنطاق العلاج، فهي تدخل في العرف وضروريات الحياة، أما بالطرق المستحدثة، كالتلقيح الاصطناعي، فلا يمكن إجبار الزوج بها.
|b Alimony is one of the financial rights in the marriage contract, so the husband is obligated to perform it, but the ancient jurists, when they spoke about its contents, did not include the expense of treatment and medicine within it, in contrast to what modern jurists said about the obligation of this type of alimony, according to a new perception imposed by the changes of life. Infertility is a disease that can be treated with traditional and new medical methods, which require significant expenses. And if the wife is infertile, is the husband obligated to this maintenance? In this study, we try to determine the extent of his obligation to do so. We concluded that the expense of treatment by traditional methods takes the rule of obligation because the legislator does not specify the scope of treatment, as it is included in the custom and the necessities of life. As for the new methods, such as artificial insemination, the husband cannot be forced to pay it.
