|a تدور الكثير من التساؤلات حول إمكانية تعديل الدستور العراقي لسنة 2005 النافذ، ودائما ما نسمع تكرار عبارة أن الدستور العراقي هو دستور جامد ولا يمكن تعديله، إن هذه العبارة غير دقيقة بشكل كامل فهي تحمل جانب من الصواب والمتمثل بجمود الدستور العراقي، ولكن هذا لا يعني عدم القدرة على تعديله عن طريق اتباع إجراءات معينة تحافظ على هيبته وتضمن قدسيته وتمنع سهولة التلاعب بنصوصه، إن عملية تعديل الدستور تواجه الكثير من المعوقات السياسية والإجرائية وهذا ما لمسناه من خلال إخفاق كل محاولات التعديل لحد الآن، بالرغم من أن عملية التعديل سوف تأتي بالكثير من المزايا، أهمها زيادة التعاون بين السلطتين التنفيذية والتشريعية، كذلك استكمال بناء المؤسسات التشريعية والتنفيذية، إضافة إلى أن تعديل الدستور وفق إجراءات معينة سيساهم في معالجة الكثير من المشاكل التي أفرزها الواقع التطبيقي للدستور العراقي منذ نفاذه في عام 2005.
|b Many questions revolve around the possibility of amending the Iraqi constitution for the year 2005 in force, and we always hear the repetition of the phrase that the Iraqi constitution is a rigid constitution and cannot be amended. The inability to modify it by following certain procedures that preserve its prestige, guarantee its sanctity, and prevent easy manipulation of its texts The process of amending the constitution faces many political and procedural obstacles, and this is what we have seen through the failure of all attempts to amend the constitution so far, although the amendment process will bring many advantages, the most important of which is increased cooperation between the executive and legislative authorities, as well as completing the building of legislative and executive institutions, in addition to Amending the constitution according to certain procedures will contribute to addressing many of the problems raised by the practical reality of the Iraqi constitution since its effective into force in 2005.
