|a تعتبر المصالحة الجمركية وسيلة إدارية وتقنية مميزة خولها القانون لإدارة الجمارك من أجل حل منازعاتها الزجرية بديلا عن بطء المساطر القضائية، ونظرا لأهميتها البالغة فإنها تتصدر مكانة خاصة في منظور القانون الجنائي للأعمال، والتي تسعى إلى الحد من العقاب، وتعزيز فكرة التحول من العدالة الزجرية إلى العدالة التصالحية التي تعد إحدى مرتكزات السياسة الجنائية المعاصرة. فالمصالحة الجمركية تشكل أسلوب قانوني متميز لإنهاء المنازعات الجمركية بسرعة وفعالية بفضل خصوصية قواعدها الموضوعية والشكلية. لذا تسعى هذه الورقة إلى تسليط الضوء على خصوصيات المصالحة الجمركية في التشريع المغربي.
|b Customs reconciliation is a distinctive administrative and technical mechanism granted by the law to the customs administration in order to resolve its penal disputes as an alternative to the slow pace of judicial procedures. Due to its significant importance, it occupies a special place within the framework of criminal business law, which seeks to reduce punishment and promote the shift from retributive justice to restorative justice, a core principle of contemporary criminal policy. Customs reconciliation constitutes a unique legal method for resolving customs disputes, owing to the particularities of its substantive and procedural rules. Thus, this paper aims to highlight these specificities within the context of Moroccan customs legislation.
