|a الوساطة القضائية وسيلة لحل بعض النزاعات التجارية التي تنشأ بين الخصوم والتي تعرض على القسم التجاري، بطريقة ودية دون اللجوء إلى إجراءات القضاء وتشعبها، ولقد عدل المشرع الجزائري بموجب القانون رقم 22-13 أحكام هذه الوسيلة، مقارنة بما كانت عليه في ظل القانون رقم 08-09 المتعلق بقانون الإجراءات المدنية والإدارية، سعيا منه لجعلها أكثر فعالية، وترتكز الوساطة على استخدام وسيط سواء شخص أو مؤسسات، بحيث يلتجأ هذا الوسيط إلى أسلوب الحوار وتبادل وجهات النظر بين المتخاصمين من أجل إيجاد حل مناسب يرضي الطرفين على حد السواء. ولقد جاءت هذه الورقة البحثية للبحث عن معنى الوساطة وبيان أهميتها وصورها وإجراءاتها وذلك وفقا للقانون الجزائري.
|b Judicial mediation is a means of resolving certain commercial disputes that arise between liabilities and that are brought before the Commercial Section. The provisions of this instrument have been amicably amended by the Algerian legislature under Act No. 22-13. In comparison with Law No. 08-09 on the Code of Civil and Administrative Procedure, In an effort to make it more effective, mediation is based on the use of an intermediary, whether a person or institutions, Such a mediator would resort to dialogue and exchange of views between the adversaries in order to find an appropriate solution that satisfies both parties. This paper seeks to clarify the meaning of mediation and its importance, forms and procedures in accordance with Algerian law.
