|a تناول البحث المادتين (143) و(144) من قانون الأحوال الشخصية الأردني رقم (15) لسنة 2019، ودرس هاتين المادتين دراسة تكشف عن المذاهب الفقهية التي ذكرت المدد التي اعتمدها قانون الأحوال الشخصية في تحرير هاتين المادتين، فقد عرض المبحث الأول الأحكام القضائية الناظمة لمدة فقد الزوج في السلم والأمن، وأن الزوجة تنتظر أربع سنوات ليفرق القاضي بينها وبين زوجها المفقود، وأما فقد الزوج في زمن الكوارث والحروب فتنتظر الزوجة سنة كاملة. ولأهمية المادة (144) وما تضمنته من أحكام ناظمة فقد أطنب البحث ببيان ما يتعلق بها بما لم يذكره شراح القانون، وقد خلص البحث إلى أن للسياسة الشرعية أثراً كبيراً في اختيار المدد واعتمادها سواء أكانت هذه المدد بالأعوام أو بالسنوات لما في كل مدة في موضعها من مصلحة تناسب المقام.
|b The research discussed articles (143) and (144) of the Jordanian Personal Status Law No. (15) of 2019. These articles were studied to reveal the jurisprudential doctrines that mentioned the periods adopted by the Personal Status Law in drafting these articles. The research presented judicial provisions regulating the period of loss of the husband in peace and security, and that the wife waits for four years for the judge to separate her from her missing husband. As for the loss of the husband during disasters and wars, the wife waits for a full year. Due to the importance of Article (144) and its provisions, the research explained what is related to it that was not mentioned by the commentators on the law. The research concluded that legitimate policy has a significant impact on choosing and adopting periods, whether these periods are in years or months, for the benefit that each period has in its place that suits the situation.
