Praise be to Allah and peace and blessings be upon the Messenger of Allah The topic of this research deals with one of the gravest social phenomena, the issue of street children, from both the perspective of legitimacy in general and the perspective of Islamic law in particular. The preface to this research briefly discusses the apparent causes behind this phenomenon based on the opinion of social scientists, humanities experts and what has been published in articles and periodicals. The research is based on two central topics: 1- Expositing the theory of guardianship in Islamic law which states that no child in society is deprived of guardianship, a matter which necessarily leads to the imposition of guardianship, by either society or the state, on street children in a manner that guarantees the obliteration of this phenomenon. This topic is divided into two discussions: a- The essence of guardianship in Islamic law, in which is discussed its definition, types, and reasons, which is further subdivided into three sections. b- Guardianship over street children in which is discussed the respective roles of the individual, society, and state towards these street children both before and after they reach the age of discretion. It delineates the authorities of a guardian and the duration of this kind of guardianship. This is further subdivided into four sections. 2- A resolution to the phenomenon, discussed in three subsections on the roles of the family, society, and state in dealing with this phenomenon. The conclusion comprises some of the results reached in this paper. Peace and blessings be upon Mohammed, the Messenger of Allah.
