المستخلص: Through this simple investigation, the researcher has focused on the rights of a certain sect of people (the accused), particularly the valid Iraqi Constitution of 2005 to verify if this sector gets constitutional protection. The researcher has really found a positive magnificent attitude of the recent constitution proving that the sector has been awarded by the recent constitution much more rights than what it had got in the previous Iraqi constitutions (the constitutions from 1925 to 1970); and also much more rights of some Arab countries' constitutions with which there had been comparison. To say the truth, the Iraqi constitution has been too much close to the international legislative limits in arrangement levels of these right. These levels are represented by International Announcement of Human Rights of 1948 and the International Covenant of the Civil and Political Rights of 1966. This assents the fact that this society has developed in all aspects. This study does not only deal with the case theoretically, but also practically in order to clarify if the constitutional clauses are applicable in the society which has been undergoing many different abuses, whether materially or incorporeally. In order to restrict those abuses we have addressed the ministries concerned, especially the Ministry of Justice, and those handling the human rights affairs, to care for this side via statistical data base containing numbers of the detained and the indictments against them, and also have those indictments released the media so that their families and relatives would know where they are detained and the legal procedures required. Doing so, the rights of those detained, mentioned in the clause (19) and (37/b/g) of the constitution more applicable. This what we are looking forward to, at present in Iraq.
