مكملات مقاصد الشريعة هي: الأمور الخادمة لمقاصد الشريعة، وهي جديرة بالبحث؛ لما لها من أثر كبير في وجود مقاصد الشريعة علي وجه الكمال، وأحسن الأحوال، كما أن فقدها يؤدي إلى اضطراب مقاصد الشريعة، ووقوعها على وجه الاختلال. ويزيدها أهمية: أن معرفتها تعين علي تحقيق التوازن والاعتدال في الفتاوى والاجتهادات والتصرفات، لا سيما في عصرنا الذي تشابهت فيه النوازل، وتشابكت فيه المسائل. لذا؛ عني الأصوليون والفقهاء بدراستها، وكان باب الإبداع والابتكار في ذلك قد فتح بأبي حامد الغزالي، وختم بالشاطبي، مرورا بالأبياري، والآمدي، والعز بن عبد السلام، والقرافي، وابن تيمية، وابن القيم، على اختلاف بينهم في درجة الإضافة العلمية، والإبداع والابتكار. وهذه المكملات قد تكون مكملات لمقاصد ضرورية أو حاجية أو تحسينية، وقد تتقدم علي المقاصد الأصلية أو تقارنها أو تكون تابعة لها، كما أنها قد تكون أحكاما وقد تكون مقاصد أخرى، وقد تكون مباشرة للمقاصد الأصلية وقد تكون مكملة لما يكملها. ومكملات المقاصد - وإن كانت تابعة لها - إلا أنه لا يلزم أن يكون المكمل موافقا لما كمله في الحكم، فقد يكون المكمل مندوبا - مثلا – ويكون الأصل واجبا، كالاغتسال لحج الفريضة. ومن قواعد مكملات المقاصد المهمة: أن المكمل لا يعتبر إذا عاد علي الأصل الذي كمله بالإبطال؛ لأن الأصل المكمل أعظم مصلحة، وأكثر منفعة. وإذا تعارض مقصد ضروري مع مكمل مقصد حاجي أو تحسيني قدم المقصد الضروري، واذا تعارض مكمل ضروري مع مقصد حاجي فأظهر القولين: أنه يبحث عن مرجح خارجي؛ لأن الحاجي نفسه مكمل للضروري. وإذا تعارضت المكملات فيما بينها قدم مكمل المقصد الأعلى علي مكمل المقصد الذي هو دونه. وفقه المكملات له أثر في النوازل المعاصرة، كإيداع الأموال في المصارف الربوية عند الاضطرار إلى ذلك، والتفريق بين الزوجين عند إصابة أحدهما بمرض الإيدز، وعلاج التشوهات بالجراحات التجميلية. وقد عرض البحث ذلك في تمهيد، وسبعة مباحث، وخاتمه، مع العناية بالتمثيل لما يذكر من التقاسيم والأنواع، وصياغة الأدلة المناقشات بلغة سهلة، وأسلوب واضح قدر الإمكان، وبالله التوفيق.
This study is entitled with "Supplements of the aims of Shari'ah, rooting & applied to some of the contemporary issues The supplements of the aims of Shari'ah are the matters, which service the aims of Shari'ah. These matters are worthy to be searched due to its significant impact in the existence of the aims of Shari'ahin a perfect way. Moreover, the lost of matters lead to the disorder of the aims of Shari'ah. What makes these matters very important is that its knowing helps to achieve the balance & moderation of legal opinions (Fatwa), especially in our recent days, where the new things are alike & the issues are interlaced. So, the jurist paid an attention to its study. The chapter of creative & invention in that was opened by Hamid Al-Ghazali, and concluded by Al-Shatbi passing by Al-Ebiari, Al-Amadi, Al- Ez Ibn Al-Islam, Al-Qarafi, Ibn Tamimah and Ibn Al-Qaim 2, with a difference between them in the degree of scientific addition, creation & invention. These supplements may be supplements to necessary aims, requirement or improvement. Also, it may exceed the origin aims or like it. Moreover, it may be laws, other aims or it may be supplement to what supplement the origin aims. The supplements of the aims, if in case of being following it, the supplement should suitable to what it supplement in the law. The supplement may be a legate & the origin is inevitable. From the rules of the important aims is that the supplement is not regarded in case of it canceled the origin, because the origin is more important. If a necessary aim contradicts with a supplement, the necessary aim should be regarded & considered. In case of a necessary supplement contradict with a need aim, we should search about an outer casting vote, because the need is a supplement to the necessary. If the supplements contradict with each other, the higher supplement is considered & regarded. The jurisprudence of supplements has an impact on the new things in our recent days, like deposit money in banks in necessity, separation between couples when one of them afflicted with HIV and treatment of deformities by plastic surgery. The research has preface, seven searches & a conclusion. Also, I paid attention to formulate the evidences and discussions in a simple & clear language. \
