هذا البحث الموسوم الفقهي الموسوم بـ: (السياسة الشرعية؛ حقيقتها ومشروعيتها وضوابطها) اشتمل في ثناياه على ذكر معنى السياسية في اللغة، وحقيقتها عند الفقهاء، مع مناقشة آرائهم في ذلك، وعرض ما تم التوصل إليه في حقيقة مفهومها، ثم بيان فوائد العمل بالسياسة الشرعية وثمرتها، والتأكيد على لزوم العمل بها؛ لما يتحقق بها من حراسة الدين، وحسن تدبير أمور الناس، ووفائها لما يجد من الحوادث والوقائع، وانقياد الناس لها تقرباً وطاعة، بما يحقق استقامة أحوالهم وانتظام أمورهم. مع تبيين وجه العلاقة بين السياسة والفقه، من حيث موضوعهما ومباحثهما، والمصادر التي يستند إليها كل منهما، وبيان أن السياسة الشرعية جزء من الفقه، ثم عرض موقف الناس من سلوك طريقها والعمل بها، ومنهج الصواب في ذلك، وبيان موقف الفقهاء من حجية السياسة الشرعية، والأدلة التي استندوا إليها في مشروعية العمل بها، ثم تم ختم البحث باستنباط جملة من الضوابط التي يلزم تحققها لاعتبار مشروعية السياسة وحجيتها، والتي تعد بمثابة ضمانة، لتحقق نفعها وصلاحها، وصون لها عن الانحراف بها عن مقصودها \
This Juristic research, which is entitled with" Shariah Policy, its facts, legality & standards" has the meaning of policy in the language & its facts at jurists. In addition, it has a discussion of their opinions concerning that. Furthermore, it displays what has reached to in the fact of its concept. Then, it mentions the benefit of working with the shariah policy & its results, and to put an emphasis on the necessity of working with it, because through it the protection of religion is obtained, the affairs of people are conducted well & the people are compliant with it, achieving the regularity of their affairs. This is accompanied with the relationship between the policy& Islamic jurisprudence in terms of their issues, researches & the references in which they depend on, and to identify that it is a part of the Islamic jurisprudence. Then, to display the people attitude from its adoption & working with it. Also, to display the attitude to the jurists from the proof of Legitimacy Policy & their evidence of working with it. Then, the research is ended by introverting a group of the legitimacy standards, which should be achieved. These standards are considered a guarantee in order to achieve its benefit & to protect it from deviation from its path
