المستخلص: At present, our community is beset with many trans¬gressions resulting from committing prohibitions. Among the gravest of these violations and the one with the most serious ramifications to the community and society are those related to honor-adultery (Allah for¬bid) or rape. There is no doubt that the detrimental consequences and effects of these crimes dramatically shake the pil¬lars of Muslim societies. Perhaps, among the most prominent problems arising from these crimes that are currently on the table, is the problem of illegitimate children. These children have nowhere to go- their home is the streets. They have become an undisputable phenomenon and a problem that cannot be ignored. In this study, the researcher attempts to make the per¬petrators bear a responsibility for the crimes they com¬mitted and to find an acceptable solution for these in¬nocent children so that they would not be punished for a crime they did not commit The researcher makes all efforts to keep this study compatible with the Qur'an, prophetic traditions, and juristic heritage. He bases his proposed solution on the opinions of imams and jurists, extrapolations from their [transmitted] scholarly opinions, or extractions from their books in light of contemporary scientific in¬formation.
