المستخلص: Home privacy is one of the most important human rights. Within home, an individual can have the most of his privacy and free from all day life stress. All legal systems agree on accounting such privacy right for the home. This to provide the security for the more general right, which is the freedom, in this respect, the protection provided is for the privacy. The term home is defined to mean the proud concept, which includes the places provided for additional use of the home. In that case, the attachments should be connected with the home. However, the home privacy does not exclude the right of the society to interfere to prevent a crime from being committed, or searching for criminals. However, these are exceptions to that rule. The exception is accorded for the police or other authorities which have a similar role within the society. Therefore, this study considers two distinct issues. The protection provided for the individual’s right and the right of the society to prevent breaching its legal and moral values. The research attempts to point the balancing area between these two concepts in accordance with the legal system of the UAE and the legal system of Jordan. The conclusion numerals some essential elements in this regard such as: • Identify the cases where it is permitted for authority to breach the home privacy. • Identify the concept of home in general • Identify the authority that allowed to breach this human right and in what circumstances. • Punishment should be toughened for the breach of this right. • The occupation of the perpetrator should be considered as a reason to toughen the punishment. \
