هذا البحث هو دراسة أصولية تهدف إلى معرفة بعض الأحكـام الـشرعية المتعلقـة بالإفتاء، وقد جعلته في خمسة مباحث: كان الأول منها في معنى الإفتاء، وأما الثاني فكان في أهمية المفتي وحاجة الناس إليه، وأما الثالث فقد بينت فيه حكم المستفتي في حالة عدم وجود المفتي، وذكرت فيه اتفاق أكثر العلماء على انتفاء التكليف عن المستفتي عند فقد المفتي، وفي المبحث الرابع بينت حكم المستفتي ذالم يجد إلامفتيا واحدا وهو وجوب الرجوع إليه ولزوم الآخذ بقتواه، وفي المبحث الخامس بينت حكم المستفتي ذا لم يجد إلا مفتياً واحداً وهو وجوب الرجوع إليه ولزوم الأخذ بفتواه، وفي المبحث الخامس بينت حكم المستفتي إذا اختلفت عليه أقوال المفتين ففي هذه الحالة عليه الترجيح بين أقوالهم كما يفعل عند اختلاف الطريقين أو الطبيبين. ثم ختمت البحث بأهم النتائج التي توصلت إليها، وأرجو أن ينتفع بها طلبة العلم ومن عليه مسؤولية الإفتاء بين المسلمين.
This research is the study of fundamentalism aimed to know the legality of certain provisions relating to advisory, I have classified the search to five chapters: The first one specialized in the meaning of the advisory, and the second one was the importance of the Mufti and the need for people to him, and the third one was shown in which the rule of ignorant in the absence of the Mufti (specialist), and I have mentioned that (there is no order on the ignorant by agreement of the most scientists), In the fourth chapter I have shown that the rule of the ignorant if he didn’t find just one Mufti (specialist) and must retuned to him and the necessity of taking his answer. At last I showed in the fifth chapter the rule of ignorant if it found different answers, in this case the ignorant would fever between answers, as it does between two roads or between two doctors. Then I ended the, search with the most important results that I reached it, so I hope to be useful for science students and who has the responsibility of giving legal opinions between Moslems.
