يستطلع هذا البحث الأحكام المتعلقة بعناصر الكفاية المعتبرة في تحديد الفقر وقدر ما يعطى الفقير من الزكاة في دارسة فقهية مقارنة مع بعض التطبيقات المعاصرة. وهي مسألة مهمة ينبنى عليها وضع أموال الزكاة في موضعها، وإيصالها لمستحقيها، وتعالج مشكلة يكثر السؤال عنها. وقد اشتملت هذه الدراسة على مقدمة، وتمهيد، وخمسة مباحث، ثم ختمت البحث بخاتمة جعلتها لأبرز توصيات البحث، وبعدها قائمة للمصادر. تحدثت في المقدمة عن أهمية الموضوع، والمنهج المتبع في البحث وخطته، وعرض الدراسات السابقة، أما التمهيد فخصصته للحديث عن الفرق بين الفقير والمسكين باختصار، ثم المباحث على النحو التالي: - المبحث الأول: الغنى المانع من أخذ الزكاة بوصف الفقر والمسكنة. - المبحث الثاني: حكم إعطاء القادر على الكسب من الزكاة. - المبحث الثالث: القدر الذي يُعطاه الفقير من الزكاة. - المبحث الرابع: إثبات الفقر والمسكنة لتحقيق استحقاق الزكاة. - المبحث الخامس: عناصر الكفاية المعتبرة في استحقاق الزكاة، وتضمن أربعة مطالب: المطلب الأول: عناصر حد الكفاية التي نص عليها الفقهاء. المطلب الثاني: عناصر مستجدة ينظر في دخولها في حد الكفاية. المطلب الثالث: ضوابط في إلزام الفقير ببيع ما فاض عن حاجته قبل أن يصير مستحقاً للزكاة. المطلب الرابع: ضوابط عامة في عناصر الكفاية.
This research examines the fiqh rulings related tothe elements of significantadequacy in determining the level of poverty and what amount of Zakat that can be given to a single poor person in a comparative jurisprudential study with some contemporary applications. It is an issue of great importance as it underlies the proper allocationof Zakah moneyand its delivery to the deserving people. Italsotreats a problem that always raises questions. This study consists of an introduction, preliminaries, and five chapters.The research is concluded with a conclusionthat contains the recommendations, followed by the reference list. The introduction discusses the importance of the topic, the research methodology and plan, and a review for previous related studies. The preliminariessection briefly differentiates between the needy (miskeen) and the poor (faqeer). The remaining chapters come are as follows: Chapter 1: The level of richness which prevents the person from taking Zakah as a poor person. Chapter 2: The fiqh rulingregarding giving a person who is able to earn a living from Zakah. Chapter 3 :The amount that can be given to a single poor person from Zakah. Chapter 4: Proving the status of poverty to assure that someone deserves Zakah. Chapter 5: Elements of significantadequacy that make someone deserves Zakah. This chapter contains four sections: Section 1: Elements of the minimum adequacy limit that has been defined by the scholars. Section 2: New contemporary elements that are to be considered as elements that may fall within the adequacy limit. Section 3 Conditions to enforce the poor to sell his surpluses before being considered deserving for Zakah. Section 4:Generalconditions and constraints on elements of adequacy.
