|a Legislation is regarded as the general official source for the law although the encircling of the whole details of the legal life is an impossible matter whether the civil or commercial treatments; the custom rules have a great role in the construing the will of both extremes generally in the civil or situation and in the commercial one specifically .custom is regarding as away for permeating of behavioral rules that carried out as an unwitting one because people are usually having a specific behavior to regulate any part of their social life from which a base will be arise to which all of them feel an obligation to follow it. \ The commercial custom appeared gradually as a condition in the merchant's agreements whether it is related to objective or legal matter and by the continuity of listing these conditions, they became classical habits, then they became indirectly understood without the need of a text for them. \ And by the continuous judgments that suppose its presence it become custom and lastly it may become stronger than legislation in its obligation and if there is any disagreement between them this may lead to the ignorance of the second and application of the first. \ So for the application of the custom the people must prove its presence and its consisting. \ The judge is not obligated to apply an unstable custom but in case of its presence he must apply it.
