The power to declare war and the state of emergency occupys prominent place among the topics of constitutional and international laws, which has led the majority of foreign and Arab constitutions ,and international agreements to address them in private articles in them, as extraordinary authorities , which face the state and threatening it’s existence and continuity as well as affects the human rights and fundamental freedoms. The importance of this subject rises from Iraqi constitutions which did not behave in the same manner ,whether it concerns the party that has the right to exercise or actions to be taken before it was announced, we must assert finally that the majority of scholars did not handle this theme clearly and precisely in line with its importance and gravity.
