|a إن مسألة تفضيل بعض الأبناء على بعض في العطية لها أثر كبير في المجتمع الإسلامي إذ يعمد بعض الآباء عن علم أو جهل إلى تفضيل أحد أبنائه أو بناته أو بعضهم فيعطيهم ما لا يعطي أولاده الباقين فيظهر أثر ذلك بعد الوفاة. \ لقد انتهجنا في بحثنا الأسلوب المقارن من خلال بيان رأي الشريعة الإسلامية مع بيان الآراء الفقهية ثم الإشارة إلى رأي القانون باعتباره التشريع النافذ في البلاد حيث تناولنا أيضاً اختلاف الفقهاء مع بيان الأدلة ومناقشتها ومن ثم كيفية التسوية بين الأبناء والمناقشة وبيان المراجع.
|b The issue of preferring some sons on others by means of financial gifts which have a significant effect on the Islamic community. Some fathers rely whether by knowledge or ignorance to prefer one of their sons or daughters upon the others. Some fathers give to a specific son what he does not give to others and this appears clearly after death. \ We relied in this research on the comparative method through clarifying the Islamic Sharea’ opinions and other opinions. Then, there is a reference to the law arguments as the legislative rules in the country. Also, we handled different experts’ opinions with evidence and discussions, references, along with the solutions of solving it out among the sons.
