تتناول هذه الدراسة الفصل السابع من ميثاق الأمم المتحدة، (فيما يتخذ من أعمال في حالات تهديد السلم الدولي والإخلال به ووقوع العدوان)، ودوره في تحقيق السلم والأمن الدوليين، وملامحه الأساسية وأهدافه وإجراءاته، من خلال التعرض لمفهوم السلم والأمن الدوليين، ومفهوم الأمن الجماعي، ودول مجلس الأمن في حفظ السلم والأمن الدوليين، والأساس القانوني للجوء إلى الفصل السابع، وحالاته، والوسائل والتدابير التي يتخذها مجلس الأمن في حالات تهديد السلم الدولي، وإجراءات اللجوء إلى استخدام القوة العسكرية تجاه الدولة التي تهدد المجتمع الدولي. وخلصت الدراسة إلى أن الفصل السابع من ميثاق الأمم المتحدة، يعد من الناحية النظرية نظاما قانونيا دوليا متكاملا، مزودا بجميع الوسائل الكفيلة بمنع وقمع الدولة المعتدية، باتخاذ التدابير التي تتناسب مع كل موقف، أما من الناحية العملية فقد أدى تغليب الجانب السياسي على الجانب القانوني، إلى تحويل الفصل السابع إلى أداة لتطويع قواعد القانون الدولي، والمواثيق الدولية لخدمة مصالح دولة ما؛ فالمشكلة ليست في نصوص القانون الدولي، وإنما في إساءة تطبيق هذه النصوص.
The present study expounds on chapter Seven of United Nations Charter, (Action with respect to threats to the peace, breaches of the peace, and acts of aggression), and it's role to maintain international peace and security. The present study is analytical, goal oriented and procedural. Within such contexts, it presents twin concepts of international peace and security. Also, it expounds concept of collective security role; Security Council to maintain or restore international peace and security; and legal legitimacy of seeking asylum. Included in Chapter Seven on illuminations on some case studies and concerted measures that the Security Council has adopted to counter threats to international peace. The discussions also, includes measures selated to asylum and the use of military force against any nation threatening international community. The present study concludes its presentation with discourse in Chapter Seven of the United Nation Charter. It sheds light on multiple perspectives theoretical, systematic, legal, international and integrative. It also provides presentation on ensuing protection and prevention against aggressive nation by taking adequate measures. In the applied domain, political aspects overwhelm legal facets. Last but not the least, Chapter Seven illuminates on basic postulates of international law and international covenants to serve global interests. The problem lies, in essence, not in the text of international law. Rather, it is rooted in the abusive applications of such texts.
